What are contents of the Appraisal Report on the feasibility study of projects using public investment capital, non-public state capital in Vietnam?

Pursuant to Clause 5, Article 71 of Decree 175/2024/ND-CP, the content of the appraisal for construction investment feasibility study includes:

- Compliance with legal regulations in the dossier content submitted for appraisal

- Consistency of the Construction Investment Feasibility Study with the investment policy approved or consented by the competent authority

- Examination of the audit report's consistency regarding the construction design for the feasibility study according to national legal regulations, ensuring construction safety, fire safety, and environmental protection

- Factors ensuring the project's feasibility, including choosing construction investment locations, scale of the investment project, identifying the investor, and forms of project management organization

- Factors ensuring project efficiency, including determining the total construction investment, the ability to mobilize funding according to the schedule, financial efficiency, and socio-economic efficiency

- Other contents as required by the investment decision-maker (if any)

What are contents of the Report on the feasibility study of construction investment in Vietnam?

According to Article 54 of the Construction Law 2014 (supplemented by Clause 12, Article 1 of the Amended Construction Law 2020), the content of the construction investment feasibility study report is stipulated as follows:

Article 54. Content of Construction Investment Feasibility Study Report

  1. The basic design is established to achieve the project's objectives, suitable for the construction works under the project, ensuring synchronization among the works upon exploitation and use. The basic design includes explanations and drawings displaying the following contents:

a) Construction location, project route, list and scale, type, and level of works under the overall construction plan;

b) Technology, techniques, and equipment options selected (if applicable);

c) Solutions for architecture, layout, sections, elevations, main dimensions, and construction structure;

d) Solutions for construction, main materials used, estimated construction cost for each work;

dd) Infrastructure connection solutions inside and outside the project, solutions for fire, explosion prevention;

e) Standards, technical regulations applied, and results of construction surveys to establish basic design.

According to the above regulations, the construction investment feasibility study report includes the following contents:

[1] The basic design is established to achieve the project's objectives, suitable for the construction works under the project, ensuring synchronization among the works upon exploitation and use. The basic design includes explanations and drawings displaying the following contents:

- Construction location, project route, list and scale, type, and level of works under the overall construction plan

- Technology, techniques, and equipment options selected (if applicable)

- Solutions for architecture, layout, sections, elevations, main dimensions, and construction structure

- Solutions for construction, main materials used, estimated construction cost for each work;

- Infrastructure connection solutions inside and outside the project, solutions for fire, explosion prevention

- Standards, technical regulations applied, and results of construction surveys to establish basic design

[2] Other contents of the construction investment feasibility study report include:

- The necessity and investment policy, construction investment objectives, construction location, and land use area, scale of capacity, and form of construction investment;

- Capability to ensure factors for project implementation such as resource utilization, technology equipment selection, human resource usage, technical infrastructure, product consumption, exploitation requirements, execution time, land clearance methods, relocation (if any), method for managing project execution, operation, and environmental protection;

- Impact assessment of the project related to land recovery, land clearance, relocation; protection of landscape, ecological environment, construction safety, fire, and explosion prevention, and other necessary contents;

- Total investment and capital mobilization, financial analysis, risks, operational costs of the construction, socio-economic impact assessment of the project; proposals for coordination mechanisms, preferential policies, and implementation support for the project;

- Other related contents.

- Housing construction investment projects, urban area construction investment projects, in addition to the above contents, must provide information regarding housing types, and compliance with social housing requirements (if any). For urban area construction investment projects, an explanation of the method for synchronizing technical infrastructure, social infrastructure of the project, and connection with technical and social infrastructure outside the project scope, and project handover plan is required.
