What are the contents of land use planning in Vietnam?

According to the provisions of the 2024 Land Law, land use planning includes the following:

[1] For national land use planning (as stipulated in Clause 2, Article 64 of the 2024 Land Law)

- Analyzing and evaluating natural factors, resources, direct impact context, and current land use of sectors and fields;

- Forecasting the trends of land use changes;

- Determining the viewpoints and objectives of land use in the new period;

- Orienting national land use, socio-economic region, land use vision to meet the land use needs for socio-economic development;

- Ensuring national defense and security;

- Protecting the environment, adapting to climate change;

- Determining land use targets for agricultural land group, non-agricultural land group; including determining the area of ​​some types of land such as paddy fields, special-use forests, protective forests, production forests, national defense land, security land;

- Solutions and resources for implementing land use planning.

[2] For provincial land use planning (as stipulated in Clause 2, Article 65 of the 2024 Land Law)

- Orienting land use as determined in the provincial planning, vision to meet the requirements of socio-economic development; ensuring national defense and security; protecting the environment, adapting to climate change;

- Determining the allocated land use targets in the national land use planning and land use targets according to provincial land use needs;

- Determining land use targets as specified in point b of this clause to each district-level administrative unit;

- Determining the boundaries, locations, and areas of coastal areas for agricultural and non-agricultural purposes;

- Enclosing areas of land use that need strict management, including paddy fields, special-use forests, protective forests, production forests;

- Phased land use planning for each 5-year plan period, including the following contents:

+ Determining the allocated land use targets in the national land use planning and land use targets according to provincial land use needs;

+ Determining land use targets as specified in point b of this clause to each district-level administrative unit;

+ Determining the boundaries, locations, and areas of coastal areas for agricultural and non-agricultural purposes;

+ Enclosing areas of land use that need strict management, including paddy fields, special-use forests, protective forests, production forests;

- Solutions and resources for implementing land use planning.

[3] For district land use planning (as stipulated in Clause 2, Article 66 of the 2024 Land Law)

- Orienting land use, vision to meet the requirements of socio-economic development; ensuring national defense and security; protecting the environment, adapting to climate change; ensuring compatibility and consistency between land use planning and transportation planning, construction planning, urban planning, rural planning;

- Determining the allocated land use targets in the provincial land use planning, which are reflected in the information to the commune-level administrative units;

- Determining land use targets according to the land use needs of district and commune levels;

- Determining the area and enclosing areas that have been allocated land use targets in the provincial land use planning according to the following regulations, including determining the area of ​​land to ensure land policy support for ethnic minority people:

+ Determining the allocated land use targets in the national land use planning and land use targets according to provincial land use needs;

+ Enclosing areas of land use that need strict management, including paddy fields, special-use forests, protective forests, production forests;

How long does the land use planning period in Vietnam last?

Based on Article 62 of the 2024 Land Law, the land use planning and land use plan periods are as follows:

Land use planning and land use plan periods

1. The period and vision of national land use planning, national defense land use planning, and security land use planning shall be implemented in accordance with the provisions of the Planning Law.

2. The period and vision of provincial land use planning shall be consistent with the period and vision of provincial planning.

3. The district land use planning period is 10 years. The district land use planning vision is 20 years.

4. The national land use plan period, provincial land use plan period is 05 years; the annual district land use plan is prepared annually.

Therefore, the land use planning periods are as follows:

- National land use planning: 10 years

- Provincial land use planning: consistent with the period of provincial planning.

- District land use planning: 10 years.
