What content does document submitting plan for selecting procurement contractors under the CPTPP Agreement include in Vietnam?

Clause 2, Article 30 of Decree 95/2020/ND-CP stipulates that the document submitting the contractor selection plan includes the following contents:

a) Part of the work performed, including the content of work related to project preparation, previous bidding packages with corresponding value and legal basis for implementation;

b) Part of the work that does not apply one of the forms of contractor selection, including: activities of the project management board, organization of compensation for site clearance, groundbreaking, inauguration, loan interest payment and other jobs cannot apply contractor selection methods;

c) The work part of the contractor selection plan, including the work content and corresponding value forming the bidding packages, is carried out according to one of the contractor selection forms specified in Article 20 and Article 21 of this Decree. In this section, the basis for dividing the project and procurement estimate into bidding packages must be clearly stated. For each bidding package, it must ensure that all contents specified in Article 29 of this Decree are included. For bidding packages applying the form of contractor appointment, in the document submitting the contractor selection plan, the reason must be clearly stated;

d) The part of work that does not meet the conditions for making a contractor selection plan (if any), clearly stating the content and value of this part of work;

d) Summary of the value of the work specified in Points a, b, c and d of this Clause. The total value of this part must not exceed the total investment of the project or approved procurement estimate.

What is appraisal of procurement contractor selection plan under the CPTPP Agreement in Vietnam? 

According to Clause 1, Clause 2, Clause 3, Clause 4, Article 31 of Decree 95/2020/ND-CP regulating appraisal of contractor selection plans, as follows:

Appraisal of the contractor selection plan is the process of examining, evaluating and giving comments based on the provisions of the law on bidding and relevant laws on the following contents:

- Legal basis for planning contractor selection;

- Conformity in dividing the project into bidding packages;

- Compliance or conformity with regulations of bidding law, other relevant laws as well as project requirements and other necessary notes (if any) for the work part of the selected plan contractors;

- The conformity of the total value of the work performed, the work that does not apply one of the forms of contractor selection, the work that is part of the contractor selection plan, the work that does not qualify conditions for contractor selection planning (if any) compared to the total investment of the approved project;

- Supervise and monitor bidding activities;

- Other necessary contents.

What is approval of procurement contractor selection plan under the CPTPP Agreement in Vietnam?

Pursuant to Clause 5, Article 31 of Decree 95/2020/ND-CP regulating approval of contractor selection plans, accordingly:

a) Based on the appraisal report, the competent person shall approve a written contractor selection plan to serve as a basis for organizing contractor selection after the project and procurement estimate are approved or at the same time with the project to approve projects and procurement estimates in cases where conditions are met;

b) Based on the appraisal report, the head of the investor or the head of the unit assigned to prepare the project shall approve the contractor selection plan for the bidding package that needs to be implemented before the approval decision is made.
