What are the contents stipulated in Decree 71 regarding specific land prices in Vietnam?

On June 27, 2024, the Government issued Decree 71/2024/ND-CP, which regulates land prices.

According to Decree 71/2024/ND-CP, it will stipulate the methods for land valuation as specified in Article 158; the establishment, adjustment, amendment, and supplementation of land price tables as specified in Article 159; specific land valuation as specified in Article 160; the conditions for practicing consultancy in land valuation as specified in point b, paragraph 3 of Article 162; and the application of land valuation methods in cases of transfer as specified in point c, paragraph 2 of Article 257 of the Land Law 2024.

The entities subject to the application of Decree 71 on land prices include:

- State management agencies in charge of land and land-related functions; agencies responsible for the establishment, adjustment, amendment, supplementation, appraisal, and decision-making on land prices; competent agencies and individuals involved in determining, appraising, and deciding specific land prices.

- Organizations providing consultancy on land valuation and individuals practicing consultancy in land valuation.

- Other relevant organizations and individuals.

What are the procedures for determining specific land prices according to Decree 71 in Vietnam?

According to Article 33 of Decree 71/2024/ND-CP, the procedures for determining specific land prices are as follows:

Step 1: Collection, synthesis, and analysis of information

- The necessary information to be collected includes information about the land plot to be valued and input information to apply land valuation methods.

The collection and synthesis of information about the land plot and input information to apply land valuation methods shall be carried out according to the forms from Form 02 to Form 03, Appendix 1 issued together with Decree 71/2024/ND-CP.

- The organization conducting land valuation is responsible for the accuracy and completeness of the information to apply land valuation methods and provide information on the results of the investigation and collection of input information to the land management authority for updating the land price database.

Step 2: Selection of land valuation methods

Based on the purpose of land use for valuation, the characteristics of the land plot, the land area to be valued, the collected information, and the conditions for applying the land valuation methods stipulated in paragraph 6 of Article 158 of the Land Law 2024, the organization conducting land valuation is responsible for analyzing and selecting the appropriate land valuation method to propose to the Council for specific land price appraisal.

Step 3: Preparation of the land price proposal report and draft valuation certificate

- The organization conducting land valuation prepares the land price proposal report and draft valuation certificate and submits them to the land management authority.

- The land price proposal report shall follow Form 16, Appendix 1 issued together with Decree 71/2024/ND-CP. The valuation certificate shall follow Form 17, Appendix 1 issued together with Decree 71/2024/ND-CP.

What does the dossier submitted to the Council for land price appraisal in Vietnam include?

According to Article 34 of Decree 71/2024/NĐ-CP, the regulations for specific land price appraisal are as follows:

Specific land price appraisal

1. The land management authority verifies the completeness of the content in the land price proposal report, prepares a submission on the land price proposal, and submits a request for land price appraisal to the Council for specific land price appraisal. The dossier submitted to the Council for specific land price appraisal includes:

a) Request for land price appraisal;

b) Submission on the land price proposal;

c) Land price proposal report and draft valuation certificate;

d) Dossier of specific land valuation.

2. The Council for specific land price appraisal appraises the land price proposal and sends the appraisal document on the land price proposal to the land management authority.

Therefore, the dossier submitted to the Council for specific land price appraisal includes:

- Request for land price appraisal;

- Submission on the land price proposal;

- Land price proposal report and draft valuation certificate;

- Dossier of specific land valuation.
