What are regulations on preparing and organizing the second stage of "one stage - two dossier bags" of procurement documents under the CPTPP Agreement in Vietnam?

Pursuant to Article 69 of the Decree 95/2020/ND-CP stipulating regulations on preparing and organizing the second stage as follows:

1. Preparation of bidding documents for the second stage:

a) Basis for making bid invitation documents:

In addition to the grounds specified in Clause 1, Article 37 of this Decree, when preparing the second-stage bidding documents, the proposals of the contractors participating in the first-stage bidding must be consulted;

b) Contents of bidding documents:

Bidding documents must stipulate criteria for evaluation of bids, including evaluation criteria for capacity and experience (For bidding packages that have undergone pre-qualification, the bidding documents do not need to specify the evaluation criteria for the contractor's capacity and experience, but it is necessary to ask the contractor to update information on the contractor's capacity), technical evaluation standards; criteria for determining the assessed price (for the case of application of the evaluation price method), determine the price point and the aggregate evaluation criteria (for the case of applying the method of combining technique and price) and other relevant contents as prescribed in Clauses 2, 3, 4, 5, 7, 8 Article 37 and Article 48 of this Decree. The bidding documents must not state any conditions to limit the participation of contractors or to create advantages for one or several bidders, causing unfair competition; does not require a contractor who has signed one or more contracts with a procuring agency of a particular country or territory or the contractor must have experience in providing goods or services in that country or territory.

2. Evaluation and approval of bidding documents:

a) Bidding documents must be appraised before approval;

b) The approval of the bidding dossier must be in writing and based on the report on approval, the report on appraisal of the bidding dossier.

3. Bidding organization:

a) The bid solicitor invites the bidders who have submitted the first-stage bids to receive the second-stage bidding documents. The issuance, amendment and clarification of the second-stage bidding documents shall comply with the provisions of Clause 2, Article 38 of this Decree;

b) Preparing, submitting, receiving, managing, amending and withdrawing bids:

The preparation, submission, receipt, management, modification and withdrawal of bids shall comply with the provisions of Clause 3, Article 38 of this Decree.

4. Bidding opening:

The bid opening shall comply with the provisions of Clause 4, Article 38 of this Decree.

Pursuant to Article 70 of the Decree 95/2020/ND-CP stipulating regulations on bid evaluation and contract negotiation of the second stage of "one stage - two dossier bags" of procurement documents under the CPTPP Agreement in Vietnam as follows:

1. The submission, appraisal, approval and publicization of contractor selection results comply with the provisions of Article 44 of this Decree.

2. Finalizing and signing the contract:

The contract signed between the parties must be consistent with the decision approving the contractor selection result, the contract negotiation minutes, the bid dossier, the bidding dossier and other relevant documents.

What are regulations on appraisal, approvement, publication of contractor selection results, completion of the signing of a one-stage, two-pack method contract of procurement under the CPTPP Agreement in Vietnam?

Pursuant to Article 71 of the Decree 95/2020/ND-CP stipulating regulations on appraisal, approvement, publication of contractor selection results, completion of the signing of a one-stage, two-pack method contract of procurement under the CPTPP Agreement in Vietnam as follows:

1. The submission, appraisal, approval and publicization of contractor selection results comply with the provisions of Article 44 of this Decree.

2. Finalizing and signing the contract:

The contract signed between the parties must be consistent with the decision approving the contractor selection result, the contract negotiation minutes, the bid dossier, the bidding dossier and other relevant documents.
