Pursuant to Article 21 of Decision 10/2022/QD-TTg stipulates:

Article 21. Methods of organizing the review of legal documents

1. Agencies and units responsible for reviewing documents must regularly review the system of legal documents at their level to suit the socio-economic situation of the City and each district under the City or when a superior state agency promulgates new documents that make the content of legal documents of the People's Council or People's Committee no longer appropriate.

2. Organize document review when receiving information, requests and recommendations from agencies, organizations and individuals on legal documents promulgated by the People's Council or People's Committee containing content Content that is illegal, contradictory, overlapping or no longer appropriate.

3. Organize document review when superior state agencies issue a Decision to announce the List of invalid documents but the document has not previously been reviewed according to the provisions of Clause 1 of this Article.

4. Agencies and units carry out reviews according to topics and fields, at the request of competent state agencies and proactively conduct reviews according to topics and fields determined by the unit.

5. Valid legal documents need to be regularly and periodically reviewed to serve the purpose of determining the validity of documents to update the National database on law, Ho Chi Minh City Official Gazette.

What is process of reviewing documents on the National Legal Database in Ho Chi Minh City, Vietnam?

Pursuant to Article 23 of Decision 10/2022/QD-TTg stipulates:

Article 23. Document review process

1. Procedure for review based on documents from superior state agencies:

a) Heads of agencies and units assign people to review documents immediately after the document that is the basis for review is approved or signed.

b) The reviewer identifies documents that need to be reviewed, makes a list, and reports to the Head of the agency or unit for decision.

c) The reviewer reviews and evaluates the basis for promulgation of the reviewed document to determine and fully assemble the document that is the basis for review according to the provisions of Article 145 of Decree No. 34/2016/ND-CP.

d) The reviewer reviews and determines the validity of the reviewed document according to the cases specified in Clause 4, Article 149 of Decree No. 34/2016/ND-CP (amended and supplemented by Clause 32 Article 1 of Decree No. 154/2020 ND-CP).

d) The reviewer reviews and evaluates the formal authority and content authority of the reviewed document.

e) The reviewer reviews and evaluates the content of the reviewed document to determine contrary, overlapping, or contradictory regulations with the document that is the basis for review.

2. Review order based on the socio-economic development situation:

a) Heads of agencies and units assign people to review documents as soon as the socio-economic situation changes that may make the content of the document no longer appropriate.

b) The reviewer identifies documents that need to be reviewed, makes a list, and reports to the Head of the agency or unit for decision.

c) The reviewer, based on the subject and scope of the document being reviewed, gathers information, documents and documents as a basis for determining changes in the socio-economic situation according to regulations on Article 146 of Decree No. 34/2016/ND-CP.

d) The document reviewer reviews and evaluates the reviewed document to determine the contents specified in Article 148 of Decree No. 34/2016/ND-CP.

3. The review of legal documents must be made into a document review file according to the provisions of Article 24 of this Regulation.
