What are principles for planning procurement contractor selection under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership in Vietnam?
At Article 26 of Decree 95/2020/ND-CP stipulates principles for planning contractor selection, specifically as follows: after:
1. Contractor selection plan is prepared for the entire project and procurement estimate. In case the conditions for making a contractor selection plan for the entire project or procurement estimate are not met, then make a contractor selection plan for one or several bidding packages to implement first.
2. The contractor selection plan must clearly state the number of bidding packages and the content of each bidding package as prescribed in Article 29 of this Decree.
3. The division of projects and procurement estimates into bidding packages must be based on technical characteristics and implementation sequence; Ensuring project uniformity, procurement estimates and reasonable contract package size.
4. Do not divide bidding packages to avoid application of this Decree.
What is market consultation in procurement under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership in Vietnam?
According to Article 27 of Decree 95/2020/ND-CP supplemented by Clause 1 Article 2 of Decree 09/2022/ND-CP regulates market consultation, as follows:
1. Before making a contractor selection plan to organize contractor selection, the procuring agency can conduct market consultation to plan contractor selection and develop bidding documents and requirements documents. In case it is necessary to select a contractor to carry out a market research package within the scope of the CPTPP Agreement, EVFTA Agreement, UKVFTA Agreement, contractor selection must comply with the provisions of this Decree.
2. Procurement agencies can use advice from experts or independent authorities or businesses in the market in planning contractor selection but must ensure competition principles, fair and transparent.

What is planning for selecting procurement contractors under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership in Vietnam?
Pursuant to Article 28 of Decree 95/2020/ND-CP regulating contractor selection planning, accordingly:
1. Basis for planning contractor selection for the project:
a) Project approval decision or Investment registration certificate and related documents. For bidding packages that need to be implemented before a decision to approve the project, it is based on the decision of the head of the investor or the head of the unit assigned to prepare the project in case it has not been determined;
b) Capital sources for the project;
c) International treaties and agreements on projects using official development assistance capital and preferential loans;
d) Results of market consultation (if any);
d) Relevant legal documents.
2. Basis for planning contractor selection for regular procurement:
a) Standards and norms of equipment and working facilities of agencies, organizations, units and officials, civil servants and public employees; Existing equipment and working facilities need to be replaced, purchased additionally, or purchased new to serve the work;
b) Procurement decision is approved;
c) Capital sources and regular procurement estimates are approved;
d) Equipment procurement project for the entire industry approved by the Prime Minister (if any);
d) Price appraisal results of agencies and organizations with the function of providing price appraisal or quotation services or results of public online bidding for similar bidding packages (if any).
3. The contractor selection plan is made after the decision to approve the project or procurement estimate or concurrently with the process of project preparation and procurement estimate or before the decision to approve the project for The bidding package needs to be implemented before a decision to approve the project is made.
