Responsibilities of the Department of Finance/Ministry of National Defense in management and use of defense land in combination with productive labor activities in Vietnam

Pursuant to Article 19 of Circular 58/2021/TT-BQP, the responsibilities of the Department of Finance/Ministry of National Defense in the management and use of defense land in combination with productive labor and economic construction activities are as follows:

1. Preside and coordinate with functional agencies to advise the Ministry of National Defense to guide units and businesses to prepare state budget needs and estimates for revenues, expenditure tasks and urge applications relevant units, businesses, organizations and individuals shall collect and pay money according to the provisions of Resolution No. 132/2020/QH14 and documents detailing implementation.

2. Preside and coordinate with functional agencies of the Ministry of National Defense, units and businesses under the Ministry of National Defense to advise and assist the Head of the Ministry of National Defense in coordinating with the Provincial People's Committee in the auction price of assets on land, transfer of land use rights according to the plan to rearrange and handle houses and land at enterprises undergoing equitization and divestment; auctioning defense land use rights that have changed use purposes after being approved by the Prime Minister.

3. Preside and coordinate with functional agencies of the Ministry of National Defense to submit to the Minister of National Defense for issuance of decisions on the management and use of revenues from labor results and investment results on land according to regulations in Clause 2, Article 6 of Resolution 132/2020/QH14 when using defense land in combination with productive labor and economic construction activities.

4. Notify military units and enterprises under the Ministry of National Defense of temporary accounts opened at the State Treasury with the Department of Finance/Ministry of National Defense holding the account to pay or transfer to organizations and individuals related to making payment.

5. Summarize and submit to the Minister of National Defense a report on revenue estimates and state budget expenditure tasks from revenues and payments specified in Clause 3, Article 14 of Decree No. 26/2021/ND-CP and point b, Point c Clause 6 Article 5 Resolution No. 132/2020/QH14 sent to the Ministry of Finance to synthesize and report according to the provisions of law on state budget.

6. Annually or irregularly as required, report and propose to the Minister of National Defense the implementation of collection and payment obligations of relevant units, businesses, organizations and individuals in the use of defense land combined with productive labor and economic construction activities.

7. Coordinate with the Department of Economics/Ministry of Defense to appraise land use plans, handling plans, plans for rearranging and handling houses and land of enterprises implementing equitization and divestment of the unit. military positions and enterprises; determine annual land use fees at equitized and divestment enterprises according to contracts signed with the Ministry of National Defense; Land use fees according to the provisions of Clause 5, Article 7 of Resolution No. 132/2020/QH14.

8. Coordinate the implementation of inspection, examination and supervision of the management and use of defense land in combination with productive labor and economic construction activities.

Pursuant to Article 20 of Circular 58/2021/TT-BQP, responsibilities of the Department of Planning and Investment/Ministry of National Defense in management and use of defense land in combination with productive labor and economic construction activities are as follows:

1. Coordinate with the Department of Finance/Ministry of National Defense and functional agencies of the Ministry of National Defense, units and businesses under the Ministry of National Defense to advise and assist the Head of National Defense in coordinating with the People's Committee at all levels province in auctioning assets on land, transferring land use rights according to the plan to rearrange and handle houses and land at enterprises implementing equitization and divestment; auctioning defense land use rights that have changed use purposes after being approved by the Prime Minister.

2. Coordinate with the Department of Economics/Ministry of Defense to appraise land use plans, treatment plans, plans for rearranging and handling houses and land of military units and enterprises undergoing equitization, divestments; determine annual land use fees at equitized and divestment enterprises according to contracts signed with the Ministry of National Defense; Land use fees according to the provisions of Clause 5, Article 7 of Resolution No. 132/2020/QH14.

3. Coordinate the implementation of inspection, examination and supervision of the management and use of defense land in combination with productive labor and economic construction activities.
