Promulgation of Circular 94/2024/TT-BQP providing detailed provisions on certain articles of the Law on Housing in the People's Army of Vietnam

On November 11, 2024, the Minister of National Defense of Vietnam issued Circular 94/2024/TT-BQP which provides detailed regulations on certain articles of the Law on Housing, including:

- Clause 9 of Article 78 regarding the form of documents proving the entity specified in Clause 7, Article 76 of the Law on Housing is entitled to the housing support policy within the management scope of the Ministry of National Defense.

- Clause 2 of Article 101 regarding the form of documents proving the entity entitled to the housing support policy for the armed forces within the management scope of the Ministry of National Defense.

- Clause 2 of Article 105 regarding the requirements for housing construction investment projects for the armed forces within the management scope of the Ministry of National Defense.

Article 2 of Circular 94/2024/TT-BQP stipulates the subjects of application include:

- Officers, professional soldiers, officials, defense workers, and public employees serving in active duty; cipher officials, and others working in cipher organizations receiving salaries from the state budget under the management scope of the Ministry of National Defense.

- Agencies, units, organizations, and individuals related to the housing construction investment projects for the people's armed forces under the management scope of the Ministry of National Defense.

What are requirements for housing construction investment projects for the people's armed forces under the management of the Ministry of National Defense of Vietnam?

Based on Article 5 of Circular 94/2024/TT-BQP, the requirements for housing construction investment projects for the people's armed forces under the management of the Ministry of National Defense of Vietnam are as follows:

Article 5. Requirements for housing construction investment projects for the people's armed forces under the management of the Ministry of National Defense

1. Housing construction investment projects for the people's armed forces under the management of the Ministry of National Defense must meet the requirements specified in Article 33 of the Law on Housing and the requirements to ensure State secrecy in the field of national defense.

2. The functional agencies of the Ministry of National Defense, implementing the orders of the Minister of National Defense, shall preside over and cooperate with relevant agencies, organizations, and individuals to carry out procedures on land, housing construction investment for the people's armed forces under the management scope of the Ministry of National Defense, ensuring compliance with the specific characteristics of the national defense sector.

Thus, housing construction investment projects for the people's armed forces under the control of the Ministry of National Defense must meet the requirements stipulated in Article 33 of the Law on Housing 2023 and requirements to ensure State secrecy in national defense.

Which subjects are entitled to housing support policies for the people's armed forces in Vietnam?

Based on Article 101 of the Law on Housing 2023 on the subjects entitled to housing support policies for the people's armed forces:

Article 101. Subjects entitled to housing support policies for the people's armed forces

1. Subjects specified in Clause 7, Article 76 of this Law are entitled to housing support policies for the people's armed forces.

2. The Minister of National Defense and the Minister of Public Security issue forms of documents proving the subjects entitled to housing support policies for the people's armed forces under management scope.

Based on Article 76 of the Law on Housing 2023 on the subjects entitled to social housing support policies:

Article 76. Subjects entitled to social housing support policies

1. People with meritorious services to the revolution, family members of martyrs who are supported to improve housing conditions as specified by the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution.

2. Poor and near-poor households in rural areas.

3. Poor and near-poor households in rural areas in regions frequently affected by natural disasters, climate change.

4. Poor and near-poor households in urban areas.

5. Low-income people in urban areas.

6. Workers and employees working at enterprises, cooperatives, and cooperative alliances both inside and outside industrial parks.

7. Officers, professional soldiers, non-commissioned officers in the people's armed forces, public security workers, officials, defense workers and public employees serving in active duty; cipher workers, others working in cipher organizations receiving salaries from the state budget.

- Officers, professional soldiers, non-commissioned officers in the people's armed forces, public security workers, officials, defense workers, and public employees serving in active duty.

- Cipher workers, others working in cipher organizations receiving salaries from the state budget while being employed.
