Procedures for changing name in the cover of the certificate of land use rights and ownership of houses and other land-attached assets (certificate) in Vietnam

Bonanza company wants to change the name on the certificate of ownership of houses to the Joint Stock Company (currently completing the procedures for converting the type of business). Please provide me with the information on the procedures, necessary documents, and fees that need to be paid.

According to Clause 4, Article 95 of the 2013 Land Law, the cases of change registration are stipulated as follows:

- The land user or the owner of land-attached assets exercises the right to exchange, transfer, lease, sublease, inherit, donate land use rights or land-attached assets; mortgage or contribute as capital land use rights or land-attached assets;

- The land user or the owner of land-attached assets is allowed to change his/her name;

- There is a change in the shape, dimension, area, number and address of the land parcel;

Thus, when your company changes its business type and the company's name has been changed, your company must register the change according to regulations.

Procedures for change registration when land users change their names are as follows:

Clause 4, Article 7 of Circular 33/2017/TT-BTNMT;

Circular 85/2019/TT-BTC.

Dossiers

- Application for land and property changes according to Form No. 09/Registration;

- Original Certificate issued;

- One of the documents related to the content of the changes:

+ Recognition document from the competent state authority as required by law for cases of individuals or family representatives changing their surname;

+ Copy of household registration book for cases where the representative of the household changes; agreement document of the household confirmed by the People's Committee at the commune level for cases where a different member in the household becomes the representative;

- Agreement document of the residential community confirmed by the People's Committee at the commune level for cases of community name changes;

+ Confirmation document from the People's Committee at the commune level regarding natural erosion for cases of reducing land area, property attached to the land due to natural erosion;

+ Proof of financial obligation payment for cases where the issued Certificate shows debt or late payment of financial obligations, except for cases where land users are exempted or not required to pay due to changes in legal regulations;

+ Decision of the competent state authority on changing restrictions on land use rights, ownership of property attached to the land stated on the Certificate for cases with restrictions according to the land allocation decision, land lease, land use rights recognition; cases with changes in restrictions according to the document transferring land use rights must have approval for the restriction change from the related rights holder, confirmed by the People's Committee at the commune level;

+ Copy of one of the documents specified in Articles 31, 32, 33, and 34 of Decree No. 43/2014/NĐ-CP showing changes in information regarding property attached to the land as recorded on the Certificate.
