What are regulations on preparation, appraisal and approval of bidding documents in the one-phase, two-pack method of procurement of bidding packages under the CPTPP Agreement in Vietnam?

Pursuant to Article 57 of the Decree 95/2020/NĐ-CP stipulating preparation, appraisal and approval of bidding documents in the one-phase, two-pack method of procurement of bidding packages under the CPTPP Agreement in Vietnam as follows:

1. Bases for making bid invitation documents as prescribed in Clause 1, Article 37 of this Decree.

2. Bid evaluation criteria include technical evaluation criteria; determine the lowest price (for the case of applying the lowest price method); fixed price determination criteria (for the case of applying the fixed price method); determine the price point and the general evaluation criteria (for the case of applying the method of combining technique and price). The bidding documents must not state any conditions to limit the participation of contractors or to create advantages for one or several bidders, causing unfair competition; does not require a contractor who has concluded one or more contracts with a procuring agency of a particular country or territory or that the contractor has experience in performing consulting services in the territory of that country or territory as the criterion for disqualification of the contractor.

3. Technical evaluation criteria: Using the scoring method to evaluate on a scale of 100 or 1,000, specifically as follows:

a) Experience and capacity of contractors: From 10% to 20% of total points;

b) Solution and methodology to implement the bidding package: From 30% to 40% of the total points;

c) Personnel performing the bidding package: Between 50% and 60% of the total points;

d) The total weight of the points specified at Points a, b and c of this Clause equals 100%;

dd) The technical proposal shall be assessed as satisfying the technical requirements when the technical score is not lower than 70% (80% for consulting bidding packages with high and specific technical requirements) total points and the score of each required content in terms of experience and capacity, solutions and methodologies, and personnel is not less than 60% (70% for consulting bidding packages with high and specific technical requirements, specific) the maximum score of that content.

4. Determination of the lowest price (in the case of application of the lowest price method) shall comply with the provisions of Point c, Clause 3, Article 37 of this Decree.

5. Determination of fixed price (for the case of applying the fixed price method):

a) Determination of the bid price;

b) Error correction;

c) Correction of deviations;

d) Subtract the discount value (if any);

dd) Convert the bid price into a common currency (if any);

e) Determination of that the proposed winning bid price does not exceed the bid package price specified and fixed in the bidding documents.

6. General evaluation criteria (for the case of applying the method of combining technique and price):

a) Determine the price point:

Use a scale of 100 or 1,000 that is consistent with the technical scale. The price point is determined as follows:

Price point under consideration =

Lowest G x (100 or 1,000)

G is considering

In there:

- Price point under consideration: The price score of the financial proposal under consideration;

- Lowest G: The lowest bid price after error correction, deviation adjustment, minus discount value (if any) is the lowest among the bidders whose financial details are evaluated;

- G under consideration: Bid price after error correction, deviation adjustment, minus the discount value (if any) of the financial proposal under consideration.

b) General evaluation criteria:

The composite score is determined according to the following formula:

Overall Score = K x Technical Score + G x Price Score

In there:

- Technical score under consideration: Is the score determined at the technical evaluation step;

- Price point under consideration: Is the score determined at the price evaluation step;

- K: The percentage of technical points specified in the general scale, accounting for 70% to 80%;

- G: The proportion of price points specified in the composite scale, accounting for the rate from 20% to 30%;

- K + G = 100%.

7. Bidding documents must be appraised before approval.

8. The approval of the bidding dossier must be in writing and based on the report on approval, the report on appraisal of the bidding dossier.

What are regulations on organization of the selection of contractors in the one-stage, two-envelope method of procurement of bidding packages under the CPTPP Agreement in Vietnam?

Pursuant to Article 58 of the Decree 95/2020/NĐ-CP stipulating organization of the selection of contractors in the one-stage, two-envelope method of procurement of bidding packages under the CPTPP Agreement in Vietnam as follows:

1. Bidding invitation:

a) The notice of invitation for bids shall be applied to cases where the short list selection procedure is not carried out and shall comply with the provisions of Point c, Clause 1, Clause 3, Article 9 and Clause 3, Article 10 of this Decree;

b) Send invitations to bids to shortlisted contractors. The invitation to bid must include the information specified in Clause 3, Article 10 of this Decree.

2. Issuing, amending and clarifying the bidding documents:

The issuance, modification and clarification of the bidding documents shall comply with the provisions of Clause 2, Article 38 of this Decree.

3. Preparing, submitting, receiving, managing, amending and withdrawing bids:

The preparation, submission, receipt, management, modification and withdrawal of bids shall comply with the provisions of Clause 3, Article 38 of this Decree.

4. Opening technical proposals:

The opening of the technical proposal shall comply with the provisions of Clause 4, Article 49 of this Decree, but shall not include the content of the bid security.

What are principles for evaluation and clarification of bids in the one-phase, two-pack method for procurement of bidding packages under the CPTPP Agreement in Vietnam?

Pursuant to Article 59 of the Decree 95/2020/NĐ-CP stipulating principles for evaluation and clarification of bids in the one-phase, two-pack method for procurement of bidding packages under the CPTPP Agreement in Vietnam as follows:

1. The evaluation of bids must comply with the principles specified in Article 39 of this Decree.

2. Clarification of bids shall comply with the provisions of Article 40 of this Decree.
