Modification of 04 Circulars related to the submission and presentation of household registration books when performing administrative procedures in the field of land in Vietnam

Is it correct that the Circular 14/2023/TT-BTNMT has 04 modifications on 04 Circulars related to the submission and presentation of household registration books when performing administrative procedures in the field of land in Vietnam?

On October 16, 2023, the Ministry of Natural Resources and Environment issued Circular 14/2023/TT-BTNMT amending and supplementing some provisions of the circulars related to the submission and presentation of household registration books and related residence documents when performing administrative procedures and providing public services in the field of land.

Circular 14/2023/TT-BTNMT modifies 04 circulars related to the implementation of administrative procedures and the provision of public services in the field of land, including:

- Amendment of Circular 24/2014/TT-BTNMT on land records;

- Amendment of Circular 34/2014/TT-BTNMT on the construction, management, and exploitation of the land information system;

- Amendment of Circular 33/2017/TT-BTNMT detailing Decree 01/2017/NĐ-CP of the Government amending and supplementing some decrees detailing the implementation of the Law on Land and amending and supplementing some provisions of the circulars guiding the implementation of the Law on Land;

- Amendment of Circular 23/2014/TT-BTNMT on the Certificate of Land Use Rights, Ownership of Houses and Other Real Estate Rights attached to land;

In addition, Circular 14/2023/TT-BTNMT repeals Clause 1, Article 2 and Clause 5, Article 11 of Circular 09/2021/TT-BTNMT amending and supplementing some provisions of the circulars detailing and guiding the implementation of the Law on Land.

What are differences between the current application for transfer of agriculture land use rights of households, individuals to perform "land lot regrouping" from 16/10/2023 and that application in the past in Vietnam?

Pursuant to Clause 1 Article 9 of the Circular 24/2014/TT-BTNMT (amended by Clause 1 Article 2 of the 09/2021/TT-BTNMT) stipulating application for registration of change to land and property on land as follows:

Application for registration of change to land and property on land

1. Application for transfer of agriculture land use rights of households and individuals to perform "land lot regrouping" submitted for all relevant households and individuals shall include:

a) Application for issuance of the certificate of land use rights and ownership of housing and other property on land, which are made using Form No. 04d/DK enclosed therewith, of each household and individual;

b) Original copy of the issued certificate or a copy of the agreement on mortgage of land use rights for land mortgaged at a credit institution;

c) Written agreement on transfer of agricultural land use rights of households and individuals;

d) Plan for transfer of agricultural land use rights of the commune-level People’s Committee approved by the district-level People’s Committee;

dd) Record of land handover under the “land lot regrouping" plan (if any).

Based on the provisions of Clause 1, Article 2 of Circular 14/2023/TT-BTNMT, which regulates the amendment and supplementation of some provisions of Circular 24/2014/TT-BTNMT of the Minister of Natural Resources and Environment on land records, as follows:

1. Amendment and supplementation of Article 9 (which has been amended and supplemented at Clause 1, Article 2 of Circular 09/2021/TT-BTNMT) as follows:

Documents to be submitted when implementing the procedures for registering changes in land use, attached property

The dossier for transferring the agricultural land use rights of households and individuals to implement "land lot regrouping" is submitted jointly for households and individuals who transfer agricultural land, including:

a) Application for registration, issuance of Land Use Rights Certificate, ownership of houses and other attached properties according to Form No. 04đ/ĐK attached to this Circular of each household and individual;

b) Original Land Use Rights Certificate or copy of the mortgage contract for the land use rights in case the land is mortgaged at a financial institution;

c) Written agreement on the transfer of agricultural land use rights of households and individuals;

d) Land use rights conversion plan of the People's Committee of the commune that has been approved by the People's Committee of the district;

dd) Receipt of land transfer according to the "land lot regrouping" plan (if any).

As regulations above, for the application for transferring the agricultural land use rights of households and individuals to implement "land lot regrouping" is submitted jointly for households and individuals who transfer agricultural land, there is no change in the content of the application.

Therefore, from October 16, 2023, the dossier for transferring the agricultural land use rights of households and individuals to implement "land lot regrouping" is submitted jointly for households and individuals who transfer agricultural land, still includes the following documents:

- Application for registration, issuance of Land Use Rights Certificate, ownership of houses and other attached properties.

- Original Land Use Rights Certificate or copy of the mortgage contract for the land use rights in case the land is mortgaged at a financial institution;

- Written agreement on the transfer of agricultural land use rights of households and individuals;

- Land use rights conversion plan of the People's Committee of the commune that has been approved by the People's Committee of the district;

- Receipt of land transfer according to the "land lot regrouping" plan (if any).

What are changes to the information to be included in the land data request form in Vietnam?

As prescribed in Article 3 of Circular 14/2023/TT-BTNMT, which regulates the amendment and supplementation of some contents of Circular 34/2014/TT-BTNMT of the Minister of Natural Resources and Environment on the construction, management, and exploitation of the land information system, the following are specified as follows:

Replacement of the phrase "ID number/Passport number" with the phrase "ID number/Citizen identity number/Passport number" in Section 1 and replacement of the phrase "ID number" with the phrase "ID number or Citizen identity number" in the Section 2 of Form No. 01/PYC.

As regulations above, from 16/10/2023, replacement of the phrase "ID number/Passport number" with the phrase "ID number/Citizen identity number/Passport number" in Section 1.
