When is the land use extension carried out?

Based on Article 172 of the Land Law 2024, which regulates the use of land within a definite period:

Article 172. Land use with a definite period

  1. The land use extension shall be conducted in the final year of the land use term, except for the case stipulated in Point a, Clause 1 of this Article. Land users who wish to extend their land use must submit an extension request no later than 06 months before the land use term expires. If the time limit for submitting the extension request has passed and the land user has not submitted the request, the land use extension will not be granted, except in cases of force majeure. If the land use extension is not granted, the competent state authorities shall recover the land according to the provisions of this Law.
  1. If the land use extension is not granted, the land user is responsible for handling the assets associated with the land to return the land to the State. If 24 months have passed since the land use term expired and the land user has not handled the assets, the State will recover the land without compensation for the land and associated assets; in the case of demolition, the asset owner must bear the demolition costs.
  1. The Government of Vietnam shall detail this Article.

Hence, the land use extension is conducted in the final year of the land use term, except for individuals directly engaged in agricultural production using annual crop land, aquaculture land, salt production land, perennial crop land, and production forest land within the specified limit.

Which types of land are used for long-term stability?

Based on Article 171 of the Land Law 2024, which regulates land used for long-term stability:

Article 171. Land used for long-term stability

  1. Residential land.
  1. Agricultural land used by community as stipulated in Clause 4 of Article 178 of this Law.
  1. Special-use forest land; protection forest land; production forest land managed by organizations.
  1. Commercial, service, non-agricultural production establishment land used stably by individuals recognized by the State, not land assigned by the State with a fixed term or for lease.
  1. Land for building agency headquarters as stipulated in Clause 1 of Article 199 of this Law; land for building public service provider facilities as stipulated in Clause 2 of Article 199 of this Law.
  1. National defense and security land.
  1. Religious land.
  1. Religious organization land stipulated in Clause 2 of Article 213 of this Law.
  1. Land used for public purposes without business purposes.
  1. Cemetery land, funeral home land, cremation facility land; land for storing ashes.
  1. Land stipulated in Clause 3 of Article 173 and Clause 2 of Article 174 of this Law.

Thus, the types of land used for long-term stability include:

- Residential land.- Agricultural land used by the community as stipulated:

+ The community is assigned land or recognized land use rights by the State to preserve ethnic identity related to customs, traditions, and religious practices.

+ The community assigned land or recognized land use rights by the State is responsible for protecting the land and not converting it for other uses.

- Special-use forest land; protection forest land; production forest land managed by organizations.

- Commercial, service, non-agricultural production establishment land used stably by individuals recognized by the State, not land assigned by the State with a fixed term or for lease.

- Land for building agency headquarters, including land for the headquarters of the Communist Party of Vietnam, state agencies, the Vietnam Fatherland Front, political-social organizations, political-social-professional organizations, social-professional organizations, social organizations, and other entities established according to law and assigned duties, supported with regular operating funds by the State.

- Land for building public service provider facilities.

- National defense and security land.

- Religious land.

- Religious organization land.

- Land used for public purposes without business purposes.

- Cemetery land, funeral home land, cremation facility land; land for storing ashes.

- Non-agricultural land used for long-term stability transferring to non-agricultural land used with a fixed term or vice versa is stably long-term.

- Land in cases:

+ The usage term for the case of converting use from non-agricultural land used for long-term stability to non-agricultural land used with a fixed term or vice versa is stably long-term.

+ The recipient of the land use right with long-term stable usage gets long-term stable usage of the land.
