Is the Separation of Residential Land Over 80m2 in Cu Chi Permitted?

I have a piece of homestead land with an area of 1000m2 located in Tan An Hoi commune, Cu Chi district, Ho Chi Minh City. I intend to divide it into 2 parcels for my two children, each with an area of 90m2 (6x15). With such an area, am I allowed to divide the plot? I hope the editorial board can assist.

According to Point b, Article 5 of Decision 60/2017/QD-UBND of the People's Committee of Ho Chi Minh City, the minimum area of a residential parcel formed and the remaining residential parcel after subdivision (after excluding the road boundary) are regulated as follows:

- Area 1 (including Districts 1, 3, 4, 5, 6, 8, 10, 11, Go Vap, Binh Thanh, Phu Nhuan, Tan Binh, and Tan Phu): minimum 36m² and the frontage width of the parcel not less than 03 meters.

- Area 2 (including Districts 2, 7, 9, 12, Binh Tan, Thu Duc, and Towns of the districts): minimum 50m² and the frontage width of the parcel not less than 04 meters.

- Area 3 (including Binh Chanh, Cu Chi, Hoc Mon, Nha Be, and Can Gio districts (except for commune-level towns)): minimum 80m² and the frontage width of the parcel not less than 05 meters.

=> Thus, your land located in Cu Chi falls under Area 3, with a minimum subdivision area of 80m² and a frontage width of the parcel not less than 05 meters. Therefore, with an area of 90m² (6x15), you are fully eligible for subdivision according to the regulations.
