Is it illegal to arbitrarily renovate an apartment building for business purposes in Vietnam? What are penalties for throwing objects from an apartment onto the street in Vietnam?
I am living in an apartment in Binh Tan district. Because there is no supermarket nearby, I want to renovate the apartment to do business for the residents in the apartment. I wonder if arbitrarily renovating an apartment building for business purposes will be punished? What will be the punishment for throwing things from an apartment onto the street? Please advise. Thank you.
Is it illegal to arbitrarily renovate an apartment building for business purposes in Vietnam?
According to Article 70 of Decree 16/2022/ND-CP on violation of regulation on management and use of apartment buildings of apartment building inhabitants are prescribed as follows:
1. A fine ranging from VND 20.000.000 to VND 40.000.000 shall be imposed on:
a) Soaking or leaking water to apartment buildings that are not under their ownership, management, or use;
b) Using paint or decorating the exterior of the flats or apartment buildings in a manner conforming to regulations on design and architecture;
c) Selling hazardous, explosive commodities, providing repair services for motorized vehicles, or cattle slaughtering services;
d) Operating restaurants, karaoke venues, or bars in commercial sections of apartment buildings without satisfying soundproofing or fire safety requirements;
dd) Running business activities in areas not reserved for business activities of apartment buildings;
e) Using flats for purposes other than residential purpose.
2. A fine ranging from VND 60.000.000 to VND 80.000.000 shall be imposed on:
a) Illegally appropriating housing area; occupying surrounding space, occupying common areas or individual areas of other owners in any shape or form;
b) Altering load-bearing structures or altering design of individual areas in apartment buildings;
c) Using areas and equipment intended for common use for individual purposes;
d) Using common areas or service areas for the wrong purposes in mixed-use apartment buildings.
3. Remedial measures:
a) Mandated restoration to original state for violations under Point a, Point b Clause 1, Point a, Point b Clause 2 of this Article;
b) Mandated relocation of hazardous, explosive commodities out of residential areas or mandated suspension of repair services for motorized vehicles or suspension of cattle slaughtering services in apartment buildings for violations under Point c Clause 1 of this Article;
c) Mandated fulfillment of soundproofing and fire safety regulations for violations under Point d Clause 1 of this Article;
d) Mandated the use of apartment flats for residential purposes for violations under Point e Clause 1 of this Article;
dd) Mandated return of areas and equipment intended for common use for violations under Point c Clause 2 of this Article;
e) Mandated the correct use of common areas or service areas in mixed-use apartment buildings for violations under Point d Clause 2 of this Article.
Thus, the act of arbitrarily repairing an apartment building for business activities can be fined from 20,000,000 to 80,000,000 VND in addition to being forced to restore the original condition in Vietnam.

What are penalties for throwing objects from an apartment onto the street in Vietnam?
Pursuant to Article 2, Appendix 1, Regulations on management and use of apartment buildings issued together with Circular 02/2016/TT-BXD stipulating prohibited acts during use of apartment buildings as follows:
1. Cause loss of security and order, talk filth and use radio, TV or sound equipment which give high-decibel noise.
2. Make a mess, drop litter or waste and toxic substances that cause environment pollution in apartment building area.
3. Throw objects out of windows or balcony of the apartment building;
4. Raise and leave livestock and poultry unbridled in the apartment building;
5. Burn votive papers, make a fire in the apartment building except in locations as prescribed.
6. Hang out the washing or put clothing and objects on handrails or the space from handrails upward or across windows of the apartment.
7. Organize activities of gambling and prostitution in the apartment building;
8. Trade in stuff that is highly explosive, inflammable representing a hazard to lives and properties of occupants.
9. Conduct illegal trade, storage and use of drugs in the apartment and other areas in the apartment building.
10. Transform uses and purposes of shared portions and facilities of the apartment buildings on one’s own initiative.
11. Other acts according to relevant law provisions on apartment buildings shall be supplemented via the apartment building meeting to accord with each apartment building.
12. Other prohibited acts as prescribed;
In Clause 4, Article 7, Decree 144/2021/ND-CP stipulates violations against regulations on public order as follows:
4. A fine ranging from 3.000.000 VND to 5.000.000 VND shall be imposed for any of the following violations:
...
e) Dumping, throwing wastes, dirty matters, chemicals, debris or other objects into a house, residence; at a person, item or property of another person; into the premises of an organization, workplace, factory, business organization, protected area or guard post thereof;
According to this Article, the act of throwing objects from an apartment onto the street can be fined from 3,000,000 to 5,000,000 VND in Vietnam.
