Is Cemetery Land Eligible for a Land Use Title (Red Book)?
Pursuant to Clause 7 Article 19 of Decree 43/2014/ND-CP stipulating cases where the Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land shall not be issued as follows:
- Individuals managing or using agricultural land belonging to the public utility land fund of a commune, ward, or commune-level town.
- ...
- Organizations and commune-level People's Committees allocated land by the State without land levy to use for constructing public work projects including roads, water pipelines, fuel pipelines, gas pipelines; electric transmission lines, information transmission lines; outdoor recreational parks; cemeteries, non-business cemeteries.
Thus, it can be seen that when land is allocated without land levy for the purpose of constructing public works such as cemeteries and non-business cemeteries as you have mentioned, the Red Book or in other words, the Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land, will not be issued.
