What are purposes for using national defense and security land in Vietnam?
Pursuant to Article 200 of the 2024 Land Law regulating national defense and security land:
Article 200. National defense and security land
- National defense and security land includes land used for purposes specified in Article 78 of this Law.
- The Provincial People's Committee shall take the lead and cooperate with the Ministry of National Defense and the Ministry of Public Security in implementing state management of national defense and security land within the administrative management scope of the locality.
- For areas within the planning for use as national defense and security land that are not yet required for defense and security purposes, the current land users can continue utilizing the land until a land recovery decision is issued by the competent state authority, but they must not alter the natural terrain.

National defense and security land is used for the following purposes:
- Military stationing, office headquarters
- Military bases
- National defense fortification works, fortifications, and special defense and security projects
- Military and security communication stations, ports, and facilities
- Industrial, scientific and technological, cultural, and sports projects serving direct defense and security purposes
- Warehouses of the people's armed forces
- Shooting ranges, training fields, weapon testing grounds, weapon destruction sites
- Training centers, training and professional development centers, convalescent, nursing, and rehabilitation centers, medical examination and treatment facilities of the people's armed forces
- Official residences for the people's armed forces
- Detention facilities; temporary detention, remand centers; compulsory education centers; juvenile reformatories and labor, rehabilitation, vocational training centers for inmates, detainees, and trainees under the management of the Ministry of National Defense and the Ministry of Public Security

In 2025, is national defense and security land available for lease in Vietnam?
Based on Clause 2, Article 84 of Decree 102/2024/ND-CP regulating the rights and obligations of units and enterprises managed by the Ministry of National Defense and the Ministry of Public Security when using national defense and security land combined with productive labor activities and economic development:
Article 84. Rights and obligations of units and enterprises managed by the Ministry of National Defense and the Ministry of Public Security when using national defense and security land combined with productive labor activities and economic development

- Leasing, mortgaging, or contributing capital using assets attached to the land must be implemented following the plans approved by the Minister of National Defense and the Minister of Public Security; ensuring effectiveness, strictness, and without affecting the execution of military, defense, and security tasks. In case of buying, selling assets attached to the land, handling mortgaged assets, or contributed capital assets, it is only implemented in banks with state shares or capital contributions or state-owned enterprise capital contributions managed by the Ministry of National Defense and the Ministry of Public Security; ensuring confidentiality requirements for military, defense, and security.
According to the above regulations, national defense and security land is not transferable, leasable, and is only used for approved purposes.
Who is permitted to use national defense and security land in Vietnam?
Based on Article 79 of Decree 102/2024/ND-CP regulating the users of national defense and security land as units directly managing and using national defense and security land:
[1] Units under the Ministry of National Defense, public service providers, state-owned enterprises managed by the Ministry of National Defense, Provincial Military Command, military commands of provinces and centrally-run cities, District Military Command in districts, district-level towns, provincial cities, cities under centrally-run cities, Provincial Border Guard Commands, Border Guard Stations, Port Border Commands, Border Guard Fleets, Commune-level Military Commands
[2] Units and public service providers under the Ministry of Public Security, provincial and centrally-run city police, district police in districts, district-level towns, provincial cities, cities under centrally-run cities, Police Stations, Commune Police, ward police, commune-level town police, special administrative-economic unit police; state-owned enterprises managed by the Ministry of Public Security and other organizations under the Ministry of Public Security established according to the law.
