Documentation to Prove Eligibility and Conditions for Purchasing, Renting, or Lease-Purchasing Social Housing
Could you please provide an advisory according to the new regulations on what documents are required to prove eligibility and conditions for purchasing, renting, or lease-purchasing social housing?Form of Papers to Prove Subjects and Conditions for Purchasing, Renting, and Rent-Purchasing Social Housing as Specified in Article 12 of Circular 09/2021/TT-BXD
(Effective from October 1, 2021)
The specific details are as follows:
For households, individuals purchasing, renting, or rent-purchasing social housing:
a) The application form for purchasing, renting, or rent-purchasing social housing shall be made according to Form No. 01 in Appendix I issued with this Circular.
- For students of academies, universities, colleges, vocational training schools; students of public ethnic boarding schools, the application form for renting social housing shall follow Form No. 10 in Appendix I issued with this Circular.
b) Form of certification regarding the subject and housing status:
- Persons with meritorious services to the revolution according to the law on preferential treatment for persons with meritorious services to the revolution (stipulated in Clause 1, Article 49 of the Housing Law) shall follow Form No. 02 in Appendix I issued with this Circular.
- Workers working in enterprises inside and outside industrial zones; commissioned officers, non-commissioned officers, technical specialists, professional soldiers, workers in public security and national defense; officials and public employees as per the law on officials and public employees (stipulated in Clauses 5, 6, and 7, Article 49 of the Housing Law) shall follow Form No. 03 in Appendix I issued with this Circular. In cases where these subjects have retired or are on leave according to laws and policies, Form No. 04 in Appendix I issued with this Circular shall be used.
- Low-income earners, poor households, near-poor households in urban areas (stipulated in Clause 4, Article 49 of the Housing Law) shall use Form No. 04 in Appendix I issued with this Circular.
- Subjects who have returned official residences (stipulated in Clause 8, Article 49 of the Housing Law) shall use Form No. 05 in Appendix I issued with this Circular.
- Students of academies, universities, colleges, vocational training schools; students of public ethnic boarding schools eligible to use housing during study time (stipulated in Clause 9, Article 49 of the Housing Law) shall follow Form No. 06 in Appendix I issued with this Circular.
- Households and individuals subject to land recovery and house clearance/demolition according to the law, without state compensation by housing or homestead land (stipulated in Clause 10, Article 49 of the Housing Law), shall use Form No. 07 in Appendix I issued with this Circular.
c) Documents proving residency conditions and social insurance contributions shall be implemented according to the regulations in Clause 16, Article 1 of Decree No. 49/2021/ND-CP.
d) Income condition certification forms:
- Workers working in enterprises inside and outside industrial zones; commissioned officers, non-commissioned officers, technical specialists, professional soldiers, workers in public security and national defense; officials and public employees as per the law on officials and public employees (stipulated in Clauses 5, 6, and 7, Article 49 of the Housing Law) shall follow Form No. 08 in Appendix I issued with this Circular. In cases where these subjects have retired or are on leave according to laws and policies, Form No. 09 in Appendix I issued with this Circular shall be used (without requiring confirmation).
- Low-income earners, poor households, near-poor households in urban areas (stipulated in Clause 4, Article 49 of the Housing Law) shall use Form No. 09 in Appendix I issued with this Circular (without requiring confirmation).
- Subjects stipulated in Clauses 1, 8, 9, and 10, Article 49 of the Housing Law are not required to provide documents proving income conditions.
In cases of reselling social housing to other subjects eligible to purchase or rent-purchase social housing as stipulated in Clause 12, Article 1 of Decree No. 49/2021/ND-CP, the buyer must have the documents proving the subjects and conditions for purchasing social housing as stipulated in Clause 1 of this Article and directly contact the project investor to submit the application for housing purchase.
For households and individuals borrowing preferential loans for new construction or renovation, repair of houses as stipulated in Clause 3, Article 16 of Decree No. 100/2015/ND-CP, the forms of documents proving subjects, housing conditions, residency, and income shall follow the forms in Appendix II issued with this Circular.
