Decision No. 25/2024/QD-TTg on the complete repeal of 9 Decisions of the Prime Minister of Vietnam in the field of land finance
Has the Decision No. 25/2024/QD-TTg on the complete repeal of 9 Decisions of the Prime Minister of Vietnam in the field of land finance been issued yet?
On December 31, 2024, the Prime Minister of Vietnam issued Decision 25/2024/QD-TTg which partially, or entirely, repels several decisions by the Prime Minister in the field of land finance.
Article 1 of Decision 25/2024/QD-TTg stipulates the complete repel of 9 decisions by the Prime Minister in the field of land finance including:
[1] Decision 44/2010/QD-TTg on the exemption of land levy, land rent for the construction of auxiliary structures for national highways.
[2] Decision 57/2010/QD-TTg concerning the exemption of land rent for projects constructing storage for 4 million tons of rice, corn, cold storage for the conservation of aquatic products, vegetables, and coffee storage according to the plan.
[3] Decision 33/2011/QD-TTg regarding granting exemption of land levy for households from fishing villages, people living on water bodies, lagoons moving to settle in resettlement zones.
[4] Decision 48/2012/QD-TTg on the amendment and supplementation of Decision No. 204/2005/QD-TTg dated August 15, 2005, by the Prime Minister.
[5] Decision 11/2015/QD-TTg providing for exemption and reduction of land levy when granting land use rights, housing ownership, and other assets attached to land to households and individuals for land with origins assigned (granted) improperly before October 15, 1993, in areas with socio-economic difficulty or special difficulty, border, island.
[6] Decision 22/2020/QD-TTg regarding the reduction of land rent in 2020 for subjects affected by the Covid-19 pandemic according to Resolution No. 84/NQ-CP dated May 29, 2020, of the Government of Vietnam.
[7] Decision 27/2021/QD-TTg concerning the reduction of land rent in 2021 for subjects affected by the Covid-19 pandemic.
[8] Decision 01/2023/QD-TTg regarding the reduction of land rent and water surface rent in 2022 for subjects affected by the Covid-19 pandemic.
[9] Decision 25/2023/QD-TTg regarding the reduction of land rent in 2023.

What issues do the Decisions of the Prime Minister of Vietnam regulate?
Based on Article 20 of the Law on Promulgation of legislative documents 2015, the Prime Minister of Vietnam issues decisions to regulate the following issues:
- Leadership and governance measures for the activities of the Government of Vietnam and the state administrative system from central to local levels, policies for working with members of the Government of Vietnam, local authorities, and other issues within the jurisdiction of the Prime Minister.
- Directive and coordination measures for the activities of members of the Government of Vietnam; monitoring the activities of ministries, ministerial-level agencies, agencies under the Government of Vietnam, and local authorities in implementing the directives and policies of the Communist Party, and the laws of the State.
Which agency is responsible for appraising the draft Decision of the Prime Minister of Vietnam?
Pursuant to Article 98 of the Law on Promulgation of Legislative Documents 2015 (amended by Clause 27; Point d Clause 53 Article 1 of the Law on Amendments and Supplements to the Law on Promulgation of Legislative Documents 2020) on the appraisal of the draft decision of the Prime Minister of Vietnam:
Article 98. Appraisal of the Draft Decision of the Prime Minister of Vietnam
- The Ministry of Justice is responsible for appraising the draft decision of the Prime Minister of Vietnam before submitting it to the Prime Minister.
For a draft decision with complex content, involving multiple sectors or fields, or drafted by the Ministry of Justice, the Minister of Justice shall establish an appraisal council, including representatives from relevant agencies, organizations, experts, and scientists.
- The dossier submitted for appraisal includes:
a) Proposal to the Prime Minister of Vietnam regarding the draft decision;
b) Draft decision;
c) Summary, explanation, reception of opinions from agencies, organizations, individuals, and those directly affected by the document; photocopies of opinions from ministries, ministerial-level agencies, and agencies under the Government of Vietnam;
d) Report assessing the impact of the policies in the draft decision; assessment of administrative procedures if the draft contains administrative procedures; report on gender equality integration, if the draft relates to gender equality issues;

The Ministry of Justice is responsible for appraising the draft decision of the Prime Minister of Vietnam before submitting it to the Prime Minister.
