Conversion of Farm Land to Residential Land
Based on Clause 3, Article 142 of the Land Law 2013 stipulated:
Households and individuals using land for farm economy are allowed to change the land use purpose according to the provisions of law.
Cases where the change of land use purpose must be approved by competent state agencies as stipulated in Article 57 of the Land Law include:
- Conversion of rice cultivation land to perennial crop land, forest land, aquaculture land, salt production land;
- Conversion of other annual crop land to saline aquaculture land, salt production land, aquaculture land in the form of ponds, lakes, swamps;
- Conversion of special-use forest land, protective forest land, production forest land to different purposes within the agricultural land group;
- Conversion of agricultural land to non-agricultural land;
- Conversion of non-agricultural land allocated by the State without land levy to non-agricultural land allocated by the State with land levy or leased land;
- Conversion of non-agricultural land other than homestead land to homestead land;
- Conversion of land for building career works, land used for public purposes with business purposes, non-agricultural production and business land other than commercial land to commercial land; conversion of commercial land, land for building career works to non-agricultural production establishment land.
Additionally, the basis for the allocation of land, leasing of land, and permission for the change of land use purpose as stipulated in Article 52 of this Law includes:
- Annual land use plans of the district level, approved by competent state authorities.
- Land use needs shown in the investment project, land allocation application, leasing application, and application for permission to change land use purpose.
Therefore, if you want to convert the land use purpose from a farm to residential land, you must rely on the annual land use plan, the land use need, and the approval from the competent authority.
In this case, you can prepare an application to change the land use purpose to non-agricultural land and subsequently, you can change the use purpose to homestead land.
