Compensation for Land When the State Recovers Homestead Land of Overseas Vietnamese?
Based on Clause 1, Article 6 of Decree 47/2014/ND-CP stipulating compensation for land when the State recovers homestead land as follows:
The compensation for land when the State recovers homestead land as stipulated in Article 79 of the Land Law is implemented as follows:
- Households and individuals currently using homestead land, Vietnamese citizens residing abroad owning houses associated with land use rights in Vietnam, when the State recovers homestead land and possess a Land Use Rights Certificate or qualify to be granted a Land Use Rights Certificate, house ownership rights, and other assets attached to the land according to land law regulations, the compensation for land is implemented as follows:
a) In cases where the entire homestead land is recovered or the remaining area of the homestead land after recovery does not meet the living conditions as regulated by the Provincial People's Committee, and the household or individual has no other homestead land or house in the commune, ward, or commune-level town where the homestead land is recovered, they will be compensated with homestead land or resettlement housing;
b) In cases where the entire homestead land is recovered or the remaining area of the homestead land after recovery does not meet the living conditions as regulated by the Provincial People's Committee, and the household or individual has other homestead land or house in the commune, ward, or commune-level town where the homestead land is recovered, they will be compensated with money. In localities that have conditions regarding the homestead land fund, compensation by homestead land will be considered.
