  1. Forms of oversight by citizens in land management and use include:

a) Directly exercising the right to oversee by reflecting, proposing to agencies and persons with authority for resolution;

b) Sending petitions to legally recognized representative organizations for them to carry out the oversight.

  1. State authorities, upon receiving citizens' reflections, and proposals, or those from representative organizations, have the following responsibilities:

a) Organize reception, classification; inspection, handling, and response in writing according to authority;

b) Transfer the petition to the competent state authority for resolution if it is beyond authority;

c) Notify the results to the organization or individual who made the reflection or proposal.

According to the above regulations, citizens directly exercise the right to oversee land management and use through reflecting and proposing to competent agencies and individuals.

Additionally, citizens can send petitions to legally recognized representative organizations for these organizations to oversee land management and use.

Which agency exercises oversight over land management and use nationwide?

Based on Article 14 of the Land Law 2024 which regulates the state’s exercise of ownership representation rights over land:

Article 14. The state’s exercise of ownership representation rights over land

The state exercises ownership representation rights over land according to the authority stipulated in this Law and related laws through the following agencies:

  1. The National Assembly, the Standing Committee of the National Assembly enact laws, ordinances, resolutions on land; decide on the national land use plan; exercise oversight over land management and use nationwide;
  1. People's Councils at all levels exercise the right to approve local land use planning before submitting it to competent authorities for approval; approve the land recovery for projects of economic and social development for national and public interest of the locality according to authority; approve the conversion of land use purposes of rice cultivation land, special-use forest land, protection forest land, and production forest land according to the authority stipulated in this Law; decide on land price tables; oversee the implementation of land law in the locality;
  1. the Government of Vietnam, People's Committees at all levels exercise ownership representation rights over land according to the authority stipulated in this Law and related laws.

Thus, the National Assembly and the Standing Committee of the National Assembly exercise oversight over land management and use nationwide.

What acts are prohibited in the field of land?

Based on Article 11 of the Land Law 2024 which stipulates the prohibited acts in the field of land, including:

- Encroaching, occupying, or destroying land.

- Violating state regulations on land management.

- Violating land policies for ethnic minorities.

- Abusing positions and powers to contravene the regulations of land management law.

- Failing to provide, or providing inaccurate land information, or failing to meet the time requirements as stipulated by law.

- Failing to prevent or handle legal violations in land matters.

- Failing to comply with legal conformity when exercising land users' rights.

- Using land or conducting transactions on land use rights without registering with competent authorities.

- Failing to fulfill or incompletely fulfilling financial obligations to the state.

- Obstructing or causing difficulties in land use or in exercising the rights of land users as stipulated by law.

- Gender discrimination in land management and use.
