Can the Provincial People's Committee Authorize the District People's Committee to Allocate Land?
Based on Clauses 1 and 4 of Article 59 of the Land Law 2013, regulations on the authority to allocate land, lease land, and permit the change of land use purpose are as follows:
The Provincial People's Committee shall decide to allocate land, lease land, and permit the change of land use purpose in the following cases:
- Allocate land, lease land, and permit the change of land use purpose for organizations;
- ...
The competent authority that decides to allocate land, lease land, and permit the change of land use purpose as stipulated in Clauses 1 and 2 of this Article is not authorized to delegate such authority.
Thus, in cases where the Provincial People's Committee has the authority to allocate land to organizations or other entities, it cannot delegate this authority to the District People's Committee or any other agency.
