Can the current Red Book be replaced with the Pink Book?
Is it possible to convert the Red Book to the Pink Book?
Clause 1, Article 76 of Decree 43/2014/ND-CP, amended by Clause 24 Article 1 of Decree 148/2020/ND-CP, stipulates cases for re-issuance of Certificates, Certificates of house ownership, and Certificates of construction ownership as follows:
- The re-issuance of Certificates, Certificates of house ownership, and Certificates of construction ownership is performed in the following cases:
a) Land users who wish to convert their Certificates of house ownership, Certificates of construction ownership, or any type of Certificate issued before December 10, 2009, to the Certificate of land use rights, house ownership rights, and other assets attached to the land;
b) The issued Certificates, Certificates of house ownership, and Certificates of construction ownership are discolored, smeared, torn, or damaged;
c) Due to re-measurement and re-determination of the parcel’s area and dimensions;
d) In cases where the land use rights and ownership of assets attached to the land are jointly owned by both spouses, but the issued Certificate only records the name of one of the spouses, and now there is a request to re-issue the Certificate to include both spouses' names.
Based on the current regulations, your case can entirely be converted from the Red Book (Certificate of land use rights) to the Pink Book (Certificate of land use rights, house ownership rights, and other assets attached to the land).
What documents are required for the conversion procedure of the Certificate of land use rights?
Clause 1 Article 10 of Circular 24/2014/TT-BTNMT stipulates the documents required for the conversion procedure of the Certificate of land use rights as follows:
- The dossier submitted for performing the conversion procedure of the Certificate, Certificate of house ownership, and Certificate of construction ownership includes:
a) An application for the conversion of the Certificate as per Form No. 10/DK;
b) The original issued Certificate;
c) A copy of the mortgage contract of the land use rights and assets attached to the land as a substitute for the original issued Certificate in the case of converting the Certificate after land consolidation, re-measurement, and re-drawing of the cadastral map, where the issued Certificate is mortgaged at a credit institution.
