Can the Commune, Ward People's Committee Organize the Forced Demolition of Houses According to the Enforcement Decision?
Clause 2, Clause 3 Article 95 of the Housing Law 2014 stipulates the enforcement of housing demolition as follows:
- The authority to issue a decision on enforced housing demolition is stipulated as follows:
a) The Chairman of the district-level People's Committee issues a decision on enforcement in cases of housing demolition to reclaim land as stipulated in Clause 3 Article 92 of this Law, and demolition of individual houses as stipulated in Clauses 1, 4, and 5 Article 92 of this Law;
b) The Chairman of the provincial-level People's Committee issues a decision on enforcement in cases of apartment building demolition as stipulated in Clauses 1, 2, 4, and 5 Article 92 of this Law.
- The district-level People's Committee is responsible for organizing the enforcement of housing demolition according to the decision on enforced housing demolition stipulated in Clause 2 of this Article.
=> According to the above regulations, the district-level People's Committee (UBND) is the agency responsible for organizing the enforcement of housing demolition. Therefore, the commune-level People's Committee (UBND) does not have the authority to organize the enforcement of housing demolition.
