Can a School Allocated Land Without Land Use Fees Transfer the Land?
According to Clause 1, Article 5 of the 2013 Land Law, it is stipulated that: Domestic organizations include state agencies, people’s armed forces units, political organizations, socio-political organizations, economic organizations, socio-political-professional organizations, social organizations, socio-professional organizations, public non-business organizations, and other organizations as stipulated by civil law (hereinafter collectively referred to as organizations).
Thus, educational institutions using land are considered organizations.
On the other hand, Clause 2, Article 173 of the 2013 Land Law stipulates that: Organizations allocated land by the State without land levy do not have the right to convert, transfer, gift, lease land use rights; mortgage, contribute capital with land use rights; and are not entitled to compensation when the State recovers the land.
Thus, educational institutions allocated land without land levy are not allowed to transfer the allotted land use rights.
