Pursuant to Article 9 of the Law on Real Estate Business 2014 stipulates as follows:
A building to be put on the market shall satisfy the following requirements:
- The ownership of the building on land is registered in the Certificate of land use right (hereinafter referred to as Certificate of land). Regarding an off-the-plan building in the real estate project, it is only required to have the Certificate of land as prescribed in regulations of law on land.
-There is no dispute about the land and ownership of the building on land.
- The building is not distrained.
Thus, the newly purchased house that meets the above conditions can still be put on the market according to regulations.
Do real estate brokerage service providers have to set up the enterprise?
Article 62 of the Law on Real Estate Business 2014 stipulates the requirements for real estate brokerage service providers:
1. Any real estate brokerage service providers must set up the enterprise and there are at least 2 employees obtaining real estate broker license (hereinafter referred to as broker license), excluding cases prescribed in Clause 2 of this Article.
2. Any individual is entitled to provide real estate brokerage services independently provided that he obtains a broker license and pays taxes as prescribed in law on taxation.
Thus, based on the above provisions, as a real estate brokerage service provider, you can choose two forms, either establishing an enterprise (company) or operating as an independent individual. Doing business in real estate services as an independent individual, you must register for tax according to regulations.
