Can a 100% Foreign-Owned Company Own Condominium Housing?
According to Article 159 of the Housing Law 2014, the subjects allowed to own houses and the forms of ownership of houses in Vietnam for foreign organizations and individuals are stipulated. To be specific:
- Foreign organizations and individuals investing in housing construction projects in Vietnam as prescribed by this Law and related legal regulations;
- Enterprises with foreign investment capital, branches, representative offices of foreign enterprises, foreign investment funds, and foreign bank branches operating in Vietnam (hereinafter collectively referred to as foreign organizations);
- Foreign individuals permitted to enter Vietnam.
Thus, your company is allowed to purchase apartments in a condominium but limited to 30% of the total number of apartments in the condominium (Point a Clause 1 Article 161 of the Housing Law 2014).
And according to Point d Clause 1 Article 10 of the Housing Law 2014, your company is allowed to lease or sell the apartments owned by your company.
