Basis for Determining Compensation, Support, and Resettlement Costs for Investment Projects Using Land

It is known that the upcoming Decree on guidelines for selecting investors will take legal effect. So, how does this Decree regulate the basis for determining compensation, support, and resettlement costs for the land area needed for clearance in investment projects using land? Based on the provisions at Point I Clause 2 Article 47 of Decree 25/2020/ND-CP (effective from April 20, 2020), the compensation, support, and resettlement costs for the land area required to be cleared (m2) are determined based on the following:

- Compensation for land;

- Remaining investment costs on the land when the State recovers land (if any);

- Compensation costs for damages to houses, construction works, assets on the land; losses in production and business when the State recovers land (if any);

- Support funds when the State recovers land (if any), including: support for stabilizing life and production; support for training, vocational change, and job finding; resettlement support; other support;

- Costs for organizing the implementation of compensation and land clearance.
