What is form to reissue the 2024 certificate of land use rights, ownership of houses and other property on land (certificate) in Vietnam?

In Form No. 10/DK issued with Circular 24/2014/TT-BTNMT, the form for application for re-issue of Certificate is specified as follows:

I hereby declare that the information declared on the application is true. If it is false, I will be fully responsible before the law.

(1) Declare the correct name and address as on the issued Certificate. In case of name change, write down information before and after the change and submit accompanying documents proving the change.

What does an application for re-issuance of Certificates include in Vietnam?

In Clause 2, Article 10, Circular 24/2014/TT-BTNMT has regulations on dossiers for re-issuance of Certificates as follows:

Application for replacement, reissuance, revision and revocation of Certificates

1. Application for replacement of the Certificate, Certificates of ownership of houses, Certificates of ownership of constructions shall include:

a) A written form of replacement of the Certificate in the Form 10 /DDK;

b) An original of the granted Certificate

c) A copy of the mortgage contract of land use rights and property on land instead of the original issued Certificate issued in case of replacement of the Certificates after regrouping of lands, measuring and drawing the cadastral map but the issued Certificate is mortgaged in credit institutions;

2. Application for reissuance of the Certificate, Certificates of ownership of houses, Certificates of ownership of constructions shall include:

a) A written form of reissuance of the Certificate in the Form 10 /DD

b) A written certification of the People’s Committees of communes on listing a notice of Certificate loss within 15 days for households and individuals; a proof of posting 03 times on local means of mass media on loss of the Certificates to organizations, religious institutions, foreign individuals, foreign organizations having diplomatic functions, foreign-invested enterprises and oversea Vietnamese carrying out the investment project; a written certification of People’s Committees of communes on such natural disaster or fires in case the Certificate is lost due to natural disasters, fires.

Thus, the application for re-issuance of the Certificate includes the following documents:

- Application for re-issue of Certificate according to form No. 10/DK issued with Circular 24/2014/TT-BTNMT.

- Confirmation from the Commune People's Committee that notice of paper loss has been posted within 15 days for households and individuals;

- Documents proving that news has been posted 3 times on local mass media about the loss of Certificates for foreign organizations, religious establishments, individuals, foreign organizations with diplomatic functions, foreign-invested enterprises and Vietnamese residing abroad implementing investment projects;

In case of loss of Certificate due to natural disaster or fire, there must be a confirmation from the Commune People's Committee about that natural disaster or fire.

Who is issued a Certificate in Vietnam?

Article 99 of the 2013 Land Law stipulates that 10 subjects are granted Certificates, including:

(1) Current land users who are eligible to be granted a certificate of land use rights and ownership of houses and other land-attached assets in accordance with Articles 100, 101 and 102 of this Law;

(2) People who are allocated land or leased land by the State from the date this Law takes effect;

(3) People who are allowed to exchange, acquire, inherit, receive land use rights as a donation, or receive land use rights contributed as capital, or to receive land use rights upon settlement of contracts on mortgage with land use rights to recover debts;

(4) People who are entitled to use land as a result of the successful conciliation of land disputes, a judgment or decision of the People’s Court, a judgment enforcement decision of the judgment enforcement agency, or a decision on settlement of land disputes, complaints or denunciations of a competent state agency, which has been executed;

(5) Land use right auction winners;

(6) People who use land in industrial parks, industrial parks, export processing zones, hi-tech zones or economic zones;

(7) People who buy houses and other land-attached assets;

(8) People who buy houses attached to residential land liquidated by the State or buy state- owned houses;

(9) People who use split or consolidated land parcels; a group of land users or members of a household, husband and wife, organizations using land who split or consolidate the existing land use rights;

(10) Land users who request change or re-grant of a lost certificate.
