Working Abroad Under a Labor Contract: Is It Possible to Make Social Insurance Contributions?
According to the provisions of Clause 1, Article 2 of the Social Insurance Law 2014, it is stipulated:
Vietnamese citizens who are employees subject to compulsory social insurance participation include:
- Employees working abroad under a contract as stipulated in the Law on Vietnamese Employees Working Abroad Under Contract;
Thus, if your child works abroad under a contract prescribed in the Law on Vietnamese Employees Working Abroad Under Contract, they will be subject to compulsory social insurance participation. However, if your child works abroad in cooperation, as an intern to enhance skills, or under other categories not under contract as stipulated in the Law on Vietnamese Employees Working Abroad Under Contract, they are not required to participate in social insurance.
If your child is required to contribute, then the party signing the contract to send your child abroad to work is responsible for paying social insurance, and a portion of the social insurance contribution will be directly deducted from your child's income. You have no obligation to pay social insurance.
