Why is it not possible to receive unemployment insurance benefits and retirement pension simultaneously?
Clause 3, Article 53 of the 2013 Employment Law stipulates:
The person receiving unemployment benefits shall have their unemployment benefits terminated in the following cases:
- The duration of receiving unemployment benefits has expired;
- Finds a job;
- Performs military service or police duty;
- Receives a monthly pension.
Therefore, a person who is receiving unemployment benefits shall have those benefits terminated when they start receiving a monthly pension.
The reason for this stipulation is because the nature of unemployment insurance policies is to partially compensate for the income of workers when they lose their jobs, supporting workers in vocational training, maintaining employment, and finding new jobs based on contributions to the Unemployment Insurance Fund.
Meanwhile, a person who is receiving a pension still has a stable monthly income. Therefore, the above provision is appropriate.
