What is the level of support for health insurance premiums from the State budget in Vietnam?

Pursuant to Article 8 of the Decree 146/2018/NĐ-CP (amended by Clause 3 Article 1 of the Decree 75/2023/NĐ-CP) stipulating State budget’s support rate as follows:

State budget’s support rate

1. From the entry into force of this Decree, the state budget’s support rates shall be applied to the following policyholders:

a) The State budget shall support 100% of the health insurance premium for people who belong to households with incomes close to the poverty line and are living in areas designated as poor by the Prime Minister and other relevant authorities;

b) The state budget’s support shall be paid for at least 70% of the health insurance contribution rate with respect to those policyholders referred to in clause 1, 2 and 5 Article 4 hereof;

c) The state budget’s support shall be paid for at least 30% of the health insurance contribution rate with respect to those policyholders referred to in clause 3 and 4, Article 4 hereof.

As regulations above, the level of support for health insurance premiums from the State budget in Vietnam is as follows:

- The State budget shall support 100% of the health insurance premium for people who belong to households with incomes close to the poverty line and are living in areas designated as poor by the Prime Minister and other relevant authorities.

- The state budget’s support shall be paid for at least 70% of the health insurance contribution rate with respect to following policyholders:

+ People who belong to households with incomes close to the poverty line, as defined by the Government of Vietnam, for the period 2022-2025, as specified in Decree 07/2021/NĐ-CP and other documents of the competent authority amending, supplementing, or replacing the standard for households with incomes close to the poverty line applicable to each period.

+ Members of multidimensional-poverty family households falling into the cases specified in point a, clause 9, Article 3 of the Decree 146/2018/NĐ-CP.

+ Ethnic minorities currently living in the area of communes in area II, area III, and special hardship hamlets in the region of ethnic minorities and mountainous areas in the 2016-2020 period, but these communes are no longer in the list of communes in area II, area III, and special hardship hamlets in the region of ethnic minorities and mountainous areas in the 2021-2025 period according to the decision of the Prime Minister.

- The state budget’s support shall be paid for at least 30% of the health insurance contribution rate with respect to following policyholders:

+ Pupils and students.

+ People who belong to households engaged in agriculture, forestry, fishing, and salt production with a middle-income level according to the standard for households with a middle-income level for the period 2022-2025 specified in Decree 07/2021/NĐ-CP and other documents of the competent authority amending, supplementing, or replacing the standard for households with a middle-income level applicable to each period.

5 groups of people who are supported by the State budget for health insurance premiums in Vietnam

Pursuant to Article 4 of the Decree 146/2018/NĐ-CP (amended by Clause 2 Article 1 of the Decree 75/2023/NĐ-CP) stipulating group of health insurance policyholders whose contributions are supported by the state budget rate as follows:

Subject 1: People who belong to households with incomes close to the poverty line, as defined by the Government of Vietnam, for the period 2022-2025, as specified in Decree 07/2021/NĐ-CP and other documents of the competent authority amending, supplementing, or replacing the standard for households with incomes close to the poverty line applicable to each period.

Subject 2: Members of multidimensional-poverty family households falling into the cases specified in point a, clause 9, Article 3 of the Decree 146/2018/NĐ-CP.

What are prohibited acts regarding health insurance in Vietnam?

Pursuant to Article 11 of the Law on Health Insurance in 2008 stipulating prohibited acts regarding health insurance in Vietnam as follows:

- Failing to pay or fully pay health insurance premiums under this Law.

- Committing fraud related to or forging health insurance files or cards.

- Using collected health insurance premiums or the health insurance fund for improper purposes.

- Obstructing, troubling or causing harms to the insured and parties involved in health insurance in the exercise of their lawful rights and enjoyment of their benefits.

- Deliberately making false reports or providing false information and data on health insurance.

- Abusing one’s position, power or professional operations to act in contravention of the health insurance law.
