What does dossier of enjoying sickness benefits for servicemen receiving inpatient treatment in Vietnam comprise?

Pursuant to Article 6 of Circular 136/2020/TT-BQP stipulating dossier of enjoying sickness benefits is as follows:

Dossier for settlement of sickness benefits as prescribed in Clauses 1, 2 and 3, Article 100 of the Law on Social Insurance, Clauses 1 and 2, Article 21 of Circular No. 56/2017/TT-BYT, specifically as follows:

1. In case of inpatient treatment: The original or copy of the hospital discharge paper of the employee or the employee's children under 7 years old; In case of referral for medical examination and treatment during inpatient treatment, a copy of the referral paper or hospital transfer paper must be included. In case the patient dies at a medical examination and treatment facility, the death notice shall be replaced; In case the death notice does not show the time of hospitalization, there is an additional document from the medical examination and treatment facility showing the time of hospitalization.

2. In case of outpatient treatment: The original certificate of leave for social insurance. In case both parents take leave to take care of a sick child, the certificate of leave of one of them is a copy; or hospital discharge certificate indicated by the doctor, the treating doctor gives additional leave after the inpatient treatment period.

3. In case the employee or the employee's child receives medical examination and treatment abroad, the dossier for enjoying the sickness benefits specified in Clauses 1 and 2 of this Article shall be replaced with a certified Vietnamese translation of medical examination and treatment certificates issued by overseas medical examination and treatment establishments.

4. In addition to the documents prescribed in Clauses 1 and 2 of this Article, the human resources agency shall make a list of requests for settlement of sickness, maternity, convalescence and health rehabilitation benefits (Form No. 01A-HBQP).

Thus, inpatient servicemen need to prepare dossiers to settle sickness benefits in Vietnam, including:

- Original or copy of hospital discharge paper;

- A copy of the referral paper, or hospital transfer paper (in case of referral for medical examination and treatment during inpatient treatment);

How many days do servicemen have to apply for sickness benefits when they return to agencies to perform their duties in Vietnam?

According to Article 7 of Circular 136/2020/TT-BQP, time limit for settlement of sickness benefits is as follows:

The time limit for settlement of sickness benefits as prescribed in Article 102 of the Law on Social Insurance shall be as follows:

1. Within 45 days from the date of return to work, the employee is responsible for submitting the dossier under the guidance in Clause 1 or Clause 2, Article 6 of this Circular to the personnel agency at the regiment level and the equivalent.

2. Within 10 days from the date of receipt of valid dossiers, the employer shall complete the settlement of the employee's sickness regime.

3. If the dossier is not processed, the dossier-receiving agency must notify the employee in writing and clearly state the reason.

According to this Article, inpatient servicemen who return to perform their duties at the agency must submit a dossier of settlement of sickness benefits within 45 days from the date of return to work to the personnel agency at the regiment level and the equivalent in Vietnam.

What is responsible process for handling sickness benefits for servicemen of regimental level personnel agency in Vietnam?

In Clause 2, Article 8 of Circular 136/2020/TT-BQP, process of responsibility for handling sickness benefits is as follows:

2. For employers of cost estimate units

a) Personnel agency at regimental level and equivalent

Guide and receive dossiers from employees according to regulations; make 02 copies of the list ( Form No. 01A-HBQP), transfer it to the financial agency of the same level, enclosed with the dossier for settlement of each employee's sickness benefits (excluding the social insurance book) and all data of the application. influence of the number of employees who propose to settle the regime.

b) Regiment level and equivalent financial authority

- Receive dossiers and list (Form No. 01A-HBQP) and all data of entitlement dossiers of the number of employees requesting for regime settlement transferred by the human resources agency; appraise and summarize in form No. 04/BHXH issued together with Circular No. 37/2017/TT-BQP dated February 16, 2017 of the Minister of National Defense guiding the management of collection and expenditure of compulsory social insurance. in the Ministry of National Defense (hereinafter referred to as Circular No. 37/2017/TT-BQP);

- Make full and timely payment of sickness benefits to employees; refuse to pay for cases of wrong calculation of the regime. When the sickness regime is issued, the employee's salary earned from the sick leave days must be recovered as prescribed;

- Quarterly, annually, summarize and make settlement reports (together with expenditures on social insurance benefits) and send them to superior financial authorities as prescribed;

- Maintain records and documents according to regulations.

c) The financial authority above the regiment and the equivalent

- Every quarter, receive the final settlement report enclosed with the list ( Form No. 01A-HBQP ) sent by the finance authority of the subordinate unit; appraise and certify the final settlement report for each unit; summarize and make a final settlement report (together with expenditures on social insurance benefits) and send it to the superior financial authority;

- Maintain records and documents according to regulations.

d) Financial agency of the unit under the Ministry

Quarterly and annually to appraise and certify the final settlement reports of affiliated units; synthesize and make a final settlement report (along with expenditures on social insurance benefits) and send it to the Ministry of Defense social insurance according to regulations.

Thus, the process of responsibility for handling sickness benefits for servicemen of the personnel agency at the regiment level is specified as above in Vietnam.
