Based on Article 106 of the 2024 Social Insurance Law, the application for one-time social insurance benefits is stipulated as follows:
Article 106. Application for one-time social insurance benefits
1. The application for one-time social insurance benefits includes:
a) Social insurance book;
b) Written request for one-time social insurance benefits from the employee.
- In cases stipulated at point b, clause 1, Article 102 of this Law, in addition to the documents required in clause 1 of this Article, a copy of the certification from the competent authorities regarding the renunciation of Vietnamese nationality or a certified or notarized Vietnamese translation of one of the following documents is required:
a) Passport issued by a foreign country;
b) Visa issued by the competent foreign authority confirming permission to enter for residency abroad;
c) Long-term permanent residency card issued by the competent foreign authority;
d) Other legal documents indicating settlement abroad as per the Vietnamese Government's regulations.
- In cases stipulated at point c, clause 1, Article 102 of this Law, in addition to the documents required in clause 1 of this Article, a summary of the medical record, the original, or a copy of the hospital discharge certificate is required.
- In cases stipulated at point d, clause 1, Article 102 of this Law, in addition to the documents required in clause 1 of this Article, an assessment record of the reduction in work capability from the Medical Examination Council or a copy of the certificate of severe disability is required.
Thus, the application for one-time social insurance benefits for voluntary social insurance participants from July 1, 2025, includes the following documents:
- Social insurance book- Written request for one-time social insurance benefits from the employee
In the case where the employee is suffering from diseases such as cancer, polio, decompensated cirrhosis, severe tuberculosis, or AIDS, a summary of the medical record, the original, or a copy of the hospital discharge certificate is required.
In the case where the employee has a work capability reduction of 81% or higher, or is severely disabled, an assessment record from the Medical Examination Council or a copy of the severe disability certificate is required.
In the case where the employee is going abroad for permanent residency, a copy of the certification from the competent authority regarding the renunciation of Vietnamese nationality or a certified or notarized Vietnamese translation of one of the following documents is required:
- Passport issued by a foreign country- Visa issued by the competent foreign authority confirming permission to enter for residency abroad- Long-term permanent residency card issued by the competent foreign authority- Other legal documents indicating settlement abroad as per the Vietnamese Government's regulations

Who are eligible to participate in voluntary social insurance?
Based on clause 4, Article 2 of the 2024 Social Insurance Law, participants in mandatory and voluntary social insurance are stipulated as follows:
Article 2. Subjects participating in mandatory and voluntary social insurance

- Subjects eligible for voluntary social insurance participation include:
a) Vietnamese citizens aged 15 years or older who are not eligible for mandatory social insurance and are not receiving pension, social insurance benefits, or monthly allowances;
b) Subjects specified at points a and b, clause 1 of this Article who are temporarily suspending the implementation of labor contracts or working contracts, except in cases where the parties agree on paying mandatory social insurance during this period.

Thus, subjects eligible to participate in voluntary social insurance include:
- Vietnamese citizens aged 15 years or older who are not eligible for mandatory social insurance and are not receiving a pension, social insurance benefits, or monthly allowances.- The following subjects who are temporarily suspending labor contracts or working contracts, except in cases where the parties agree on paying mandatory social insurance during this period:
+ Persons working under indefinite-term labor contracts, fixed-term labor contracts with a duration of one month or more, even if the labor contract is called differently but reflects employment with remuneration, salary, and management, direction, and supervision by one party.

When is the commencement date of one-time social insurance benefits?
Based on Article 102 of the 2024 Social Insurance Law, one-time social insurance benefits are stipulated as follows:
Article 102. One-time social insurance benefits

- The amount of one-time social insurance benefits for subjects supported by the State is implemented as prescribed in clause 2 of this Article and does not include the government's contribution to voluntary social insurance, except in cases specified at points c and d, clause 1 of this Article.
4. The commencement date for one-time social insurance benefits is the date specified in the decision of the social insurance agency.
- In cases where employees stipulated at points b, c, and d clause 1 of this Article meet both the conditions for receiving a pension and for one-time social insurance benefits, the employee may opt to receive either a pension or one-time social insurance benefits.
- the Government of Vietnam shall provide detailed regulations for this Article.
Thus, the commencement date for one-time social insurance benefits is the date specified in the decision of the social insurance agency.
Note: The 2024 Social Insurance Law takes effect from July 1, 2025.
