What are the regulations on unemployment insurance for participants eligible for occupational training assistance in Vietnam?
Under Article 2 of the Decision 17/2021/QD-TTg in :
1. employees eligible for occupational training assistance according to regulations in Article 55 of the Law on Employment (hereinafter collectively referred to as “employees”).
2. Vocational education institutions and higher education institutions having registered for provision of vocational education at college level and enterprises, regulatory bodies and organizations permitted to provide vocational education and participating in occupational training for employees (hereinafter collectively referred to as “training institutions”).
3. Departments of Labor - War Invalids and Social Affairs; social insurance authorities; employment agencies established by employment authorities and regulatory bodies involved in occupational training assistance for employees.
Article 55 of the Law on Employment 2013 stipulates the conditions for occupational training assistance in Vietnam:
Employees specified in Clause 1, Article 43 of this Law who are paying unemployment insurance premiums are eligible for occupational training assistance when they fully meet the following conditions:
1. Fully satisfy the conditions specified in Clauses 1, 3 and 4, Article 49 of this Law;
2. Have paid unemployment insurance premiums for full 09 months or more in 24 months before the termination of the employment or working contract as prescribed by law.
What are occupational training assistance rates for employees participating in unemployment insurance in Vietnam?
Under Article 3 of the Decision 17/2021/QD-TTg on the occupational training assistance rates for employees participating in unemployment insurance in Vietnam:
1. Occupational training assistance rates
a) employees taking an occupational training course lasting for up to 3 months are eligible for an amount that is calculated based on the tuition charged by the training institution and actual training time but shall not exceed VND 4.500.000/ person/ course.
b) employees taking an occupational training course lasting for more than 3 months are eligible for a monthly amount that is calculated based on the tuition and actual training time but shall not exceed VND 1.500.000/ person/ month.
If employees take an occupational training course the duration of which does not make up full months according to regulations of the training institution, the odd days shall be calculated as follows: 14 odd days or fewer shall be regarded as half a month and 15 odd days or more shall be regarded as 01 month.
2. Applications for occupational training and provision of occupational training assistance are provided for in Articles 24 and 25 of the Government’s Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of a number of Articles of the Law on Employment on unemployment insurance (amended by the Government’s Decree No. 61/2020/ND-CP dated May 29, 2020).
3. On a monthly basis, training institutions shall carry out procedures for provision of occupational training assistance according to regulations in Article 25 of the Government’s Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of a number of Articles of the Law on Employment on unemployment insurance (amended by the Government’s Decree No. 61/2020/ND-CP dated May 29, 2020).
