Violations of Social Insurance will not be Subject to Criminal Liability
Pursuant to Clauses 1 and 2, Article 122 of the Social Insurance Law 2014 stipulating the handling of violations in the field of social insurance as follows:
- The agency or organization having acts violating the provisions of this Law shall, depending on the nature and severity of the violation, be subject to administrative sanctions; if causing damage, they must compensate according to the provisions of law.
- Individuals having acts violating the provisions of this Law shall, depending on the nature and severity of the violation, be subject to administrative sanctions, disciplinary actions, or criminal prosecution; if causing damage, they must compensate according to the provisions of law.
Thus, criminal prosecution in the field of insurance will not be applied to organizations, but will be applied to individuals.
