Violations of Regulations on the Use of Machinery and Equipment with Strict Safety and Labor Hygiene Requirements: How Are They Handled?
According to the provisions of Article 23 of Decree 28/2020/ND-CP, effective from April 15, 2020, violations of regulations regarding the use of machines and equipment with strict safety and occupational hygiene requirements are specified as follows:
A fine shall be imposed on organizations and individuals violating regulations on the use of machines, equipment, and materials with strict safety requirements as follows:
From VND 1,000,000 to VND 2,000,000 for failing to report to the Department of Labor, Invalids, and Social Affairs at the local jurisdiction within 30 days before or after commissioning machines, equipment, materials, or substances with strict safety requirements.
From VND 5,000,000 to VND 10,000,000 for not maintaining complete technical documentation of machines, equipment, and materials with strict safety requirements.
From VND 15,000,000 to VND 20,000,000 for violating regulations in the national technical standards on safety and occupational hygiene in the use of machines, equipment, and materials with strict safety requirements; using machines, equipment, and materials not certified in accordance with corresponding national technical standards; using machines, equipment, and materials without clear origin or that are past their expiration date.
From 2 times to 3 times the total inspection cost of the violating machines, equipment, and materials (calculated based on the minimum price set by the competent authority), but not less than VND 20,000,000 and not exceeding VND 75,000,000 for not inspecting before commissioning or not conducting periodic inspections during the use of machines, equipment, and materials with strict safety requirements.
From VND 50,000,000 to VND 75,000,000 for continuing to use machines, equipment, and materials with strict safety requirements that have undergone inspection but failed to meet the required standards.
