Vietnam: Will a male employee undergoing a vasectomy be entitled to take maternity leave?
Vasectomy is one of the sterilization measures for males in Vietnam. Employees, regardless of gender, who take sterilization measures are entitled to maternity benefits (Point dd, Clause 1, Article 31 of the Social Insurance Law 2014).
Article 37 of this Law stipulates that when taking contraceptive measures, employees are entitled to maternity benefits as prescribed by competent health establishments. The maximum leave period is:
a/ 7 days, for female employees implanted with intrauterine devices;
b/ 15 days, for employees taking sterilization measures.
2. The maternity leave period specified in Clause 1 of this Article is inclusive of public holidays, New Year holidays and weekends.
Thus, in the case of a male employee undergoing a vasectomy (sterilization), he is entitled to a maximum of 15 days off under maternity benefits as prescribed by a competent health establishment. The leave period includes public holidays, Tet holidays, and weekly breaks.
