Vietnam: Is a female employee who has an intrauterine device inserted during maternity leave entities to insurance benefits?
According to Point dd, Clause 1, Article 31 of the Social Insurance Law 2014, female employees having intrauterine devices or employees taking sterilization measures in Vietnam are entitled to maternity benefits.
According to Article 37 of the Social Insurance Law 2014 on leave period when taking contraceptive measures in Vietnam:
- When taking contraceptive measures, employees are entitled to the maternity benefits as prescribed by competent health establishments. The maximum leave period is:
+ 7 days, for female employees implanted with intrauterine devices;
+ 15 days, for employees taking sterilization measures.
- The maternity leave period specified in Clause 1 of this Article is inclusive of public holidays, New Year holidays and weekends.
=> Essentially, allowing employees to take a 7-day leave when having an intrauterine device inserted in Vietnam is to ensure that the female employee's health and psychological state stabilize. In this case, since the female employee is already on maternity leave, she is naturally resting. Therefore, in my opinion, if the female employee has an intrauterine device inserted during maternity leave, additional leave will not be granted.
