Vietnam: Are male employees who pay compulsory social insurance premiums entitled to maternity benefits?
Clause 1 of Article 31 of the Social Insurance Law 2014 stipulates that employees in Vietnam shall be covered by maternity benefits in one of the following cases:
a/ Pregnant female employees;
b/ Female employees giving birth to children;
c/ Female employees as surrogate mothers and intended mothers;
d/ Employees adopting under-6-month children;
dd/ Female employees having intrauterine devices or employees taking sterilization measures;
e/ Male employees currently paying social insurance premiums whose wives give birth to children.
Thus, male employees who pay compulsory social insurance premiums in Vietnam, depending on the case, may be entitled to maternity benefits when:
- They adopt a child under 06 months old;
- They take sterilization measures;
- Their wife gives birth.
