Vietnam: Use of digital signatures to conduct money transfer transactions in the Social Insurance Sector

What are the regulations on use of digital signatures to conduct money transfer transactions in the Social Insurance Sector in Vietnam? Which legislative document stipulates this matter?

The use of digital signatures to conduct money transfer transactions in the Social Insurance Sector is prescribed in Article 8 of the Regulations issued under Decision 1166/QD-BHXH of 2020. To be specific:

  1. Digital signatures used in electronic transactions with Vietnam Social Security must be digital signatures corresponding to the digital certificates issued by public digital signature authentication service providers or issued by specialized digital signature authentication service providers for political system agencies.

  2. The use of digital signatures between transaction units and Vietnam Social Security is carried out according to the following regulations:

- Before using digital signatures to carry out electronic transactions with Vietnam Social Security, transaction units must notify the digital signatures of relevant individuals of the transaction unit participating in electronic transactions  with Vietnam Social Security. The digital signatures of individuals participating in electronic transactions with Vietnam Social Security must be associated with specific titles and types of transactions.

- In cases of changes to the notified information, renewal, suspension, or changes to the digital certificates; or changes to the key pair, the units participating in electronic transactions must notify and update the digital signature information with Vietnam Social Security.

3. The use of digital signatures in electronic bilateral payments and data exchange regarding social insurance, health insurance, and unemployment insurance premium payment between social insurance agencies and commercial banks where accounts are opened shall follow the agreement between Vietnam Social Security and each commercial bank system. During implementation, if any changes arise regarding the information related to the digital signature on behalf of their system, the party making the changes must notify the other party at least one (01) month before the change applies.

4. The use of digital signatures in providing information for preparing government financial statements between Vietnam Social Security and information providers is carried out according to the regulations of the Ministry of Finance.

5. The use of digital signatures in electronic transactions between social insurance agencies and other organizations is carried out according to agreements between Vietnam Social Security and each organization.
