Treatment for Alcohol Addiction: Eligibility for Sick Leave Policies
According to Clause 2, Article 3 of Circular 59/2015/TT-BLDTBXH regulating the conditions for receiving sickness benefits as follows:
Sickness benefits will not be granted in the following cases:
- Employees suffering from illness or accident who have to take leave due to self-inflicted harm, alcohol consumption, or use of narcotics or drug precursors according to the List issued together with Decree No. 82/2013/ND-CP dated July 19, 2013 of the Government of Vietnam promulgating the lists of narcotics and drug precursors, and Decree No. 126/2015/ND-CP dated December 09, 2015 of the Government of Vietnam amending and supplementing the List of narcotics and drug precursors issued together with Decree No. 82/2013/ND-CP dated July 19, 2013 of the Government of Vietnam promulgating the lists of narcotics and drug precursors.
- Employees taking leave for initial treatment due to occupational accidents or occupational diseases.
- Employees suffering from illness or accidents other than occupational accidents during their annual leave, personal leave, unpaid leave according to labor laws; or those on leave enjoying maternity benefits as prescribed by the laws on social insurance.
Thus, according to the information you provided, your father suffers from health issues caused by alcohol addiction, affecting his sleep, and the family took him for treatment. In this case, it can be determined that the employee is ill due to alcohol use. Therefore , based on the above regulation, your father will not be entitled to sickness benefits.
