Three cases where the insurer is entitled to refuse selling compulsory fire and explosion insurance
According to the current legal regulations, an enterprise experiencing a fire or explosion still has the right to refuse to sell mandatory fire and explosion insurance.
To be specific, in Clause 3 Article 3 of Decree 23/2018/ND-CP on mandatory fire and explosion insurance, promulgated by the Prime Minister of the Government of Vietnam, there are provisions on cases where the insurer has the right to refuse to sell mandatory fire and explosion insurance as follows:
- The facility has not been approved for fire prevention and fighting according to legal regulations.
- The facility does not have a safety inspection record for fire prevention and firefighting from the Fire Prevention and Fighting Police agency, or the inspection record is more than 01 year old from the date of issuance to the date of purchasing mandatory fire and explosion insurance.
- The facility is temporarily suspended or ceased from operation due to violations of fire prevention and firefighting regulations.
