Severe Illness Caused by Alcohol: Eligibility for Sick Leave Policies?
According to Article 25 of the Law on Social Insurance 2014, the conditions for entitlement to sickness benefits when participating in compulsory social insurance are stipulated as follows:
- Suffering from illness or accident, not related to occupational accidents, requiring leave from work and having confirmation from a competent medical examination and treatment facility as prescribed by the Ministry of Health.
- In cases of illness or accident requiring leave from work due to self-harm, intoxication, or the use of narcotic substances, precursor narcotic substances as listed by the Government of Vietnam, sickness benefits shall not be granted.
- Requiring leave from work to take care of a child under 07 years old who is ill and having confirmation from a competent medical examination and treatment facility.
=> Thus, according to the information you provided, your severe hepatitis, which prevents you from continuing to work, is determined to be caused by alcohol. Therefore, according to the regulations, you are not entitled to sickness benefits.
