Regarding the Annual Finalization of Social Insurance Books
In Clause 5, Article 21 of the Law on Social Insurance 2014, it is stipulated:
Coordinate with the social insurance agency to return the social insurance book to the employee, confirm the duration of social insurance contribution when the employee terminates the labor contract, working contract, or resigns as per legal regulations.
=> Therefore, according to the above regulations, the finalization of the social insurance book and contribution period for employees is done when the employees terminate the labor contract, contract, or resign. The social insurance book is not finalized for employees annually.
Additionally, in Clause 3, Article 48 of the Labor Code 2019, it is stipulated:
The employer has the following responsibilities:
- Complete the procedure for confirming the duration of social insurance contribution, unemployment insurance, and return these together with the original documents if the employer has kept them from the employee;
- Provide copies of documents related to the employee's working process if the employee requests so. The cost of copying and sending documents is borne by the employer.
Respectfully.
