Recovery Care after Maternity for 07 Days Due to C-Section: How Much Will Be Received?
Article 41 of the Social Insurance Law 2014 stipulates convalescence and health recovery after maternity as follows:
- Female employees immediately after the period of maternity leave as prescribed in Article 33, Clause 1 or Clause 3 of Article 34 of this Law, within the first 30 days of returning to work and if their health has not yet recovered, are entitled to take leave for convalescence and health recovery from 05 to 10 days.
The convalescence and health recovery leave period includes public holidays, New Year's holidays, and weekends. In cases where the convalescence and health recovery leave period crosses from the end of the previous year to the beginning of the following year, that period of leave shall be counted for the previous year.
The number of days for convalescence and health recovery leave stipulated in Clause 1 of this Article shall be decided by the employer and the Executive Committee of the grassroots trade union. If the employing unit has not yet established a grassroots trade union, the employer shall decide. The convalescence and health recovery leave period is regulated as follows:
a) A maximum of 10 days for female employees who give birth to twins or more in one delivery;
b) A maximum of 07 days for female employees who give birth via surgery;
c) A maximum of 05 days for other cases.
The level of benefit for convalescence and health recovery after maternity leave is 30% of the statutory pay rate per day.
The current statutory pay rate according to Decree 38/2019/ND-CP is VND 1,490,000.
Therefore, in the case where your company allows you to take 05 days of convalescence after maternity leave, you shall be paid 5 x 1,490,000 x 30% = VND 2,235,000.
