Receiving Unemployment Insurance Benefits While Employed: Legal Implications
According to Point c, Clause 1 and Clause 3, Article 39 of Decree 28/2020/ND-CP regulating violations regarding the preparation of dossiers to enjoy social insurance benefits and unemployment insurance as follows:
- A fine ranging from VND 1,000,000 to VND 2,000,000 for employees who commit the following acts: The person receiving unemployment benefits does not notify the Employment Service Center as prescribed when falling into one of the following cases: having a job; performing military service, police duty; receiving a monthly pension; studying for a fixed term of 12 months or more.
- Required to repay the social insurance organization the amount of social insurance and unemployment benefits received due to the commission of this violation.
Thus, an employee who is receiving unemployment benefits and does not notify the Employment Service Center when they have a job may be fined up to VND 2 million and required to repay the unemployment benefits received. This is the penalty for individuals (Clause 2, Article 5 of this Decree).
