Maximum Unemployment Allowance Entitlement for Employees
Pursuant to Clause 1, Article 8 of Circular 28/2015/TT-BLDTBXH guiding the implementation of Article 52 of the Employment Law and certain provisions of Decree 28/2015/ND-CP guiding the Employment Law on Unemployment Insurance issued by the Minister of Labor – Invalids and Social Affairs, it is stipulated that:
The monthly unemployment allowance for employees is determined as follows:
Monthly Unemployment Allowance = Average salary of the 6 consecutive months with unemployment insurance contributions before unemployment x 60%.
The maximum monthly unemployment allowance for an employee shall not exceed 5 times the statutory pay rate for employees subject to the State-regulated salary policies or not exceed 5 times the regional minimum wage prescribed by the Labor Code for employees paying unemployment insurance under the salary policies decided by the employer at the time of termination of the labor contract.
=> As you have indicated, you meet all conditions for unemployment allowance and will begin unemployment on January 15, 2019. You work in District 5, HCMC, which falls under Region I. From January 1, 2019, the regional minimum wage for Region 1 will be 4,180,000 VND/month, compared to the previous regulation of 3,980,000 VND/month. Therefore, according to the regulation, your maximum monthly unemployment allowance shall not exceed 5 times the regional minimum wage.
