Leave for Caring for a Sick Child: Is a Birth Certificate Required?
According to Article 100 of the Social Insurance Law 2014, the dossier for sickness benefit includes:
The original or a copy of the hospital discharge paper for employees or employees' children undergoing inpatient treatment. If the employee or the employee's child undergoes outpatient treatment, a social insurance leave certificate is required.
In the case where the employee or the employee's child seeks medical treatment abroad, the dossier stipulated in Clause 1 of this Article shall be replaced by a Vietnamese translation of the medical certificate issued by the foreign medical facility.
A list of employees on sick leave prepared by the employer.
The Minister of Health prescribes the form, order, and authority to issue social insurance leave certificates, hospital discharge papers, and the forms stipulated in Points c, d, and dd Clause 1 Article 101 of this Law.
Thus, in a case where you take leave to care for a sick child, you should submit the original or a copy of the hospital discharge paper if your child is undergoing inpatient treatment, or a social insurance leave certificate if your child is undergoing outpatient treatment to complete the dossier for sickness benefit.
Therefore, you do not need to submit your child's birth certificate but only need to prepare one of the aforementioned documents to claim the sickness benefit.
